STATUS OF PERMIT: Permit To Operate (PTO) issued April 19, 2016 PTO expired on April 19, 2021 PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: None OBSERVED VIOLATIONS: A. 15A NCAC 13B .0201(c) states in part: “No solid waste management facility shall be established, operated, maintained, constructed, expanded, or modified without a valid permit issued by the Division for the specified type of activity. It is the responsibility of every owner or operator of a proposed solid waste management facility to apply for a permit for the facility. The term "owner" shall include record owners of the land where the facility is located or proposed to be located and holders of any leasehold interest, however denominated, in any part of the land or structures where the facility is located or proposed to be located.” FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 4 During the inspection, disposal of Land Clearing Inert Debris (LCID) material from recent disposal activities was observed. The Permit Number 41-S to operate the D&D Grading, Inc. LCID Landfill expired on April 19, 2021. Therefore, D&D Grading, Inc. is in violation of 15A NCAC 13B .0201(c) for operating a LCID landfill without a valid permit and for failing to apply to apply to renew the expired permit. To achieve compliance, submit a permit renewal application request and updated facility plans for the operation of the D&D Grading, Inc. LCID Landfill to the Section. B. 15A NCAC 13B .0203(d) states: “By receiving solid waste at a permitted facility, the permittee shall be considered by the Department to have accepted the conditions of the permit and shall comply with the conditions of the permit.” Permit Number 41-S, Attachment III, Facility Specific Conditions Part I, Permit Condition Number 1 states: “This Permit to Operate expires April 19, 2021. Pursuant to 15A NCAC 13B .0201(g), no later than October 15, 2020, the owner or operator must submit a request to the Section for permit review and must submit updated facility plans meeting the requirements of Rule 0.565 and .0566.” A permit renewal application request and updated facility plans were not submitted to the Section for permit review by October 15, 2020, therefore D&D Grading, Inc. is in violation of 15A NCAC 13B .0203(d). To achieve compliance, submit a permit renewal application request and updated facility plans for the operation of the D&D Grading, Inc. LCID Landfill to the Section. ADDITIONAL COMMENTS On September 29, 2022, Chuck Kirchner and Robert Pike met with David Dick to conduct an inspection of the D&D Grading, Inc. LCID Landfill located at 1411 Rankin Mill Road in Greensboro, Guilford County. 1. The facility is a land clearing and inert debris (LCID) landfill and is owned and operated by David Dick. 2. The facility permit has expired and is no longer valid. 3. Contact Ming-Tai Chao, Permitting Engineer, with the Division of Waste Management, Solid Waste Section, Permitting Branch to discuss permit renewal requirements. Mr. Chao can be reached at 919-707-8251 or at ming.chao@ncdenr.gov. 4. The landfill is primarily used by D&D Grading, Inc. 5. The D&D Grading, Inc. personnel operate the LCID landfill and were available during this unannounced inspection. 6. The facility permit expired on April 19, 2020. Please see the Observed Violations section of this report. On October 27, 2022, the facility consultant contacted the Section Permitting Staff and has stated that surveying work has been completed and a submittal package is being prepared. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Ensure any LCID material disposed of on site is compacted and covered as required in the previous permit. 9. The facility was permitted to receive land clearing waste, yard trash, untreated and unpainted wood, uncontaminated soil, inert debris, and (used) asphalt. No previously unauthorized wastes were observed on site during this inspection. 10. During the inspection, the working face appeared to be properly maintained. 11. Per 15A NCAC 13B .0566(3), “Solid waste shall be restricted to the smallest area feasible and compacted as densely as practical into cells.” 12. Per 15A NCAC 13B .0566(4), “Adequate soil cover shall be applied monthly, or when the active area reaches one acre in size, whichever occurs first.” 13. Excavation, grading, and fill material side slopes shall not exceed three to one (3:1). 14. A ready supply of soil is available on the west side of Phase 1A for cover material. 15. Permanent edge of waste markers have been installed. Permanent markers that accurately delineate the waste disposal boundary must be maintained throughout life of the landfill per permit Attachment III, Condition #8. 16. Open burning of land clearing waste is prohibited. If a fire occurs, the permittee must provide oral notification to the Section within 24 hours of the occurrence followed by a written report of the details of the fire within 10 working days of the occurrence. 17. The facility annual report (FAR) was received by the SWS, dated July 7, 2022. Estimated facility throughput for July 2021 through June 2022 is 416 tons. There was no indication of erosion or runoff. 19. Access roads are of all-weather construction. 20. The facility is secured by a locked gate. 21. The facility has a proper sign.
