The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
On October 13, 2022, Chuck Kirchner met with Bruce Woody, Tyler Lunsford and Lee Cloer to conduct a comprehensive inspection of the Orange County C&D Landfill on Eubanks Road in Chapel Hill, Orange County.
1. The construction and demolition debris (C&D) landfill (permit number 68-04) is located adjacent to the Orange County Closed Municipal Solid Waste (MSW) Landfill (South Landfill), the Orange County Closed MSW Landfill (North Landfill), the Orange County Closed C&D Landfill (North Landfill), the Orange County Household Hazardous Waste (HHW) Collection Facility, and the wood grinding area (permit number 68-01). 2. The facility is open Monday through Friday 7:00 am - 4:00 pm and Saturday 8:00 am - 12:00 pm. 3. The facility permit and permit application comments were discussed. 4. The permit currently authorizes operation of the C&D landfill (PTO), Phase 1 and 2. The permit also includes a permit to construct phase 3 and the vertical expansion phases 4 and 5. 5. Six inches of earthen material, used as cover, is required weekly and when the disposal area exceeds one-half acre.
6. The working face appeared small and compact. 7. The landfill cap, side slopes, and groundcover appeared maintained. 8. Some windblown litter from the day’s operations observed. Continue to collect and properly dispose of windblown litter at the conclusion of each day of operation. 9. Provide additional cover over exposed waste in Phase 1 as discussed in the field. 10. There was no indication of erosion or runoff.
11. Landfill edge of waste markers were observed. 12. C&D waste currently being placed in Phase 2 area of the landfill. 13. No unauthorized waste observed in the working face. 14. Orange County recently purchased a new grinder for LCID material. The county discussed using the grinder for C&D material at the C&D working face. 15. Grinding of C&D material is not included in the Site Operations Plan (FID 1378553). An updated Operations Plan shall be approved prior to grinding of any C&D waste in accordance with 15A NCAC 13B .0302.
16. The operations plan will require a modification to segregate ACM from waste stream prior to grinding wastes. The County shall contact the Health Hazard Control Unit of the NC Health Department https://epi.dph.ncdhhs.gov/asbestos/ahmp.html and obtain an approval for the asbestos abatement plan. In addition, the operator may need an asbestos training credential prior to doing the plan waste grinding.
17. Mr. Woody stated that Orange County plans to grind pallets and use mulch to stabilize access road to working face of the C&D landfill. Non-C&D pallets are banned from disposal in the C&D landfill. Non-C&D pallets shall be ground in the LCID area and only the amount of mulch necessary to stabilize the access road shall be used. 18. The landfill sediment basin appeared maintained. 19. Ensure loose plastic material near plastic recycling bales are cleaned up as discussed in the field. 20. Landfill Gas Wells and Groundwater Wells observed this inspection accessible and in good condition. There is a
landfill gas (distribution) trunk line with eight passive vent risers adjacent to the west external side slope. 21. Six inches of earthen material, used as cover, is required weekly and when the disposal area exceeds one-half acre.
22. The facility maintains waste screening reports. A waste screening is required weekly or at > 1% by weight of the previous week’s total. Records were observed for October 20, 2020 through September 29, 2022. 23. The facility maintains throughput records. From July 1, 2022 through September 30, 2022 Orange County C&D landfill received 2,805.63 tons of C&D waste, 305.14 tons of tires, 1,390.4 tons of vegetative waste, 49.07 tons of clean wood/pallets and 76.1 tons of stumps and land clearing debris. No intact mobile homes have come to the facility this quarter according to Mr. Cloer. 24. A Facility Annual Report was submitted to the Solid Waste Section on July 26, 2022. From July 1, 2021 through June 30, 2022 the landfill received 22,799.17 tons of C&D waste. In addition, the landfill also received 989.62 tons
of metal, 339.96 tons of white goods, 186.04 tons of wood, 6,119.66 tons of yard waste and 958.57 tons of tires.

25. The facility maintains semiannual groundwater monitoring test records prepared by Draper Aden Associates, conducted by Sherrill Environmental, Inc., and analyzed by ENCO (Environmental Conservation Laboratories, Inc.). Groundwater records were observed for May 17, 2021, November 23, 2021 and May 23, 2022. An
exceedance was noted for each event. 26. The facility maintains quarterly methane monitoring records. Methane monitoring is conducted by facility personnel. Records were observed for September 28, 2020 through September 14, 2022. No exceedance of the
methane lower explosive limit (LEL) was noted. 27. The facility maintains quarterly hydrogen sulfide, tetrahydrofuran and 1,4 Dioxane monitoring records that mirror the methane monitoring dates. No exceedance was noted. 28. The facility uses a Landtec GEM 5000 methane detection unit, S/N 6504951, rented from Environmental Equipment out of Pineville, NC. Calibration record observed for September 8, 2022. Unit is sent to Landfill quarterly to perform LFG monitoring and then is sent back to Environmental Equipment upon completion. 29. The facility maintains weekly landfill cover of the C&D landfill. Weekly cover log observed from October 30, 2020 through September 29, 2022. C&D only uses 6” of soil for weekly cover material. 30. Orange County has a Temporary Disaster Debris Staging Site (TDDSS, DS68-002) located adjacent to the active area of the C&D landfill in the undeveloped area allotted for Phases 2 and 3. This site was last deactivated on March 13, 2019.

32. The TDSR DS68-002 will need to be closed or relocated as phase 2 and phase 3 of the C&D landfill progress. DS68-001 is also located at this facility east of the closed landfill and DS6-004 is north of this facility off Mill House Road. 33. The New Hope Fire Department can be contacted to address an emergency at the facility. 34. Fires must be reported to the regional Environmental Senior Specialist with 24 hours or the occurrence, followed by a written notification within 15 calendar days of the occurrence according to the 15A NCAC 13B rules and approved plan (FID1574662). 35. The facility has an all-weather access road. 36. The facility is secured by a locked gate. The facility sign is located at the entrance to the scale house on Eubanks Road across from the C&D landfill.
