PURPOSE OF SITE VISIT: Follow-up Partial Compliance Inspection STATUS OF PAST NOTED VIOLATIONS: A. 15A NCAC 13B .0405 (b), “Water that comes into contact with solid waste is leachate and shall be collected from the site for disposal to an approved facility or discharged directly from the site into a sanitary sewer line.” Permit to Operate, Attachment 3, Part VI (24), “All water or liquid that comes in contact with solid waste, including vehicle wash-down water is leachate and must be captured and properly treated before release into the environment.” PARTIALLY RESOLVED: A sampling plan and supporting documentation was submitted to and approved by the Section, sampling was satisfactorily conducted, and affected soils were removed. The facility was awaiting additional analytical data at the time of this inspection. Straw wattles had been placed along the edge of the FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 6 transfer trailer loading bay access road to catch waste. Straw wattles do not contain or stop the flow of leachate completely. Multiple areas between and below the straw wattles were observed to have allowed probable leachate to escape the access road pavement. It may be necessary to install a permanent small berm or curbing along the perimeter of the loading bay access road or take other measures to ensure that any leachate from the apron or the loading bay is contained and directed to the leachate collection system. OBSERVED VIOLATIONS: A. 15A NCAC 13B .0405 (b), “Water that comes into contact with solid waste is leachate and shall be collected from the site for disposal to an approved facility or discharged directly from the site into a sanitary sewer line.” During this inspection, evidence of leachate and motor oil releases originating from a trailer staging area, vehicle maintenance shelter, and possibly from a leaking above-ground storage tank were observed converging and then running down the adjacent south side hill into the stormwater detention basin. Measures should be implemented to prevent contaminants from escaping the trailer staging area, maintenance shelter and storage tanks should be inspected for leaks and repaired, or liquids recovered as needed. Ensure any impacted soils are excavated and disposed of properly and subsurface soils evaluated as necessary. The subsurface soils will need to be evaluated for possible contaminants. The transfer trailer staging area contained dark and discolored stains within the gravel lot from possible trailer leaks. Ensure all transfer trailers are actively inspected for leaks and repaired as needed. Soil from stained areas within the transfer trailer staging area lot should be excavated and properly disposed of as soon as they are observed. This area may need to be evaluated as well should evidence of continued leaking occur in this area 2. Multiple areas of the concrete apron leading up to the tipping floor are damaged/cracked and retaining leachate. It is recommended that these areas of the apron be repaired to eliminate potential migration of leachate into the adjacent gravel driveway area and subsurface soils. 3. During the previous inspection on 8/4/2022, a leachate containment trough located to the west of the transfer station building had multiple holes and had leaked onto the concrete pad and adjacent soil. It was observed during this inspection that the containment trough had been disposed of, but the impacted soil remained evident in this area. As noted in the previous inspection, any impacted soils in this area should be excavated and disposed of properly and subsurface soils evaluated as necessary. 4. It is recommended that the operator conduct regular site inspections for compliance and any issues observed addressed in a timely manner. 5. Corrective measures are necessary as a result of this inspection. 6. Digital photographs were taken during this inspection. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
