The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and
any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. All photos were taken by Lee Hill on October 12, 2022 unless otherwise noted.
2. The facility entrance is secured by a gate and a portion of the facility is fenced to prevent unauthorized access. In
areas where fencing has not been installed, topography serves to limit access as well.
Records Review
3. Tonnage records were reviewed from the FY2021-2022 Facility Annual Report. The facility received 179,034
tons of material from July 1, 2021 to June 30, 2022. The increase in annual tonnage was due to the ongoing
cleanup of Tropical Storm Fred debris which impacted the area on August 17, 2021. On September 13, 2021,
the Section approved a request from Haywood County to exclude storm debris from the permitted annual
disposal tonnage limits of the facility.
4. Landfill gas monitoring was being performed quarterly as required. Monitoring was conducted on December
20, 2021, February 2, 2022, April 7, 2022, and August 5, 2022 and no exceedances were noted.
5. North Carolina Certified Landfill Manager:

6. Richard James and Mike Kirkpatrick's North Carolina Certified Landfill Operator Certificates have expired but
are enrolled in the Labella Certified Landfill Operator course scheduled for November 8, 2022.
7. Semi-annual groundwater monitoring was conducted October 19, 2021 and April 25-27, 2022 and the results
were submitted to the section for review.
8. Waste screening forms from January 4, 2021 to October 5, 2022 were available for review. The forms showed
the disposition of any unacceptable waste that was encountered.
Operations Inspection of the MSWLF Unit (4407-MSWLF-1993)
9. The facility is currently filling in Phase 4 and construction of Phase 513 has begun.
10. The access roads were constructed of all-weather material and were being maintained in good condition.
11. Windblown waste was minimal and facility staff were actively picking up litter at the time of inspection.
12. The working face was manageable size, and no unapproved material was observed.
13. Waste was observed around the area immediately surrounding where the tarp was stored near the working face.
Please ensure any waste deposited during movement of the tarp is collected and properly disposed by the
end of the working day.
14. Some waste was observed on the slopes of Phase 5A where the facility was in the process of cutting in a berm
to divert storm water from the construction of Phase 513. After the inspection, facility staff sent photos of the
area showing that the area had been covered with soil.
15. Edge of waste (EOW) markers, constructed of wooden posts, were installed around the perimeter of the cell as
required.
16. The leachate pond had adequate freeboard and no visual deficiencies were observed in the liner.
