STATUS OF PERMIT:
In 1973. Landfill operations began in Phase 1 on this property. Facility Permit 51-03 is a combination of facility permits
51-01 and 51-02.
Permit to Construct Johnston County MSW Landfill, Phase 6 issued May 8, 2020.
Permit to Operate 5103-MSWLF Phase 4A and 5103-CDLF Area 2 Cells 1 and 2 issued May 8, 2020.
Permit for Closure for MSW Phases 1 through 4 and C&D Area 1 issued May 8, 2020.
Life of Site Permit for 5103-MSWLF and 5103-CDLF issued May 8, 2020 and will expire August 8, 2057.
Permit to Construct Johnston County MSW Landfill Phase 6 issued November 30, 2021.
Permit to Operate 5103-MSWLF Phase 4A, 5, and 6A and C&D Area 2, Cells 1 and 2 issued November 30, 2021.

STATUS OF PAST OBSERVED VIOLATIONS:
A. 15A NCAC 13B .1626 (8)(d), "Leachate shall be contained within a lined disposal cell or leachate collection
and storage system."
The January 21, 2021 leachate release was resolved by the Section on January 19, 2022.

CONTINUING VIOLATIONS: The leachate sampling plan for the November 2021 Phase 4A leachate release
was submitted in on December 2, 2021. During the January 19, 2022 communication, Ms. Christine Ritter, Section
Hydrogeologist, reminded Joan Smyth of Smith + Gardner to submit the soil sampling results for the November
2021 leachate release. No further communication has been received regarding the November 2021 leachate release.
During this inspection, numerous leachate releases were identified at the toe of the southern side slope of Phase 4A.
The leachate was flowing down the drainage ditch and staining indicated that the leachate had flowed across the
access roadway. The stormwater inlet located near the southwestern corner of Phase 4A was identified to have been
covered with sediment from the southern side slope. Mr. Beasley stated that a few weeks ago the drainage ditch had
been cleaned out, graded, and the excavated soil placed on top of Phase 4A. Following the cleanout, a 4-inch
rainstorm had eroded the area and filled the ditch with sediment. Mr. Beasley also stated that there was a pre -bid
meeting at 1300 on September 22, 2022 for the closure of Phase 4A. Mr. Beasley stated that the prevention of the
leachate releases would be part of the closure discussion of Phase 4A. On September 23, 2022, Mr. Beasley provided
the Section with a photograph of the excavated and cleaned out stormwater inlet.
OBSERVED VIOLATIONS:
A. 15A NCAC 13B .1626 (2)(c), "Areas which will not have additional wastes placed on them for 12 months or
more, but where final termination of disposal operations has not occurred, shall be covered with minimum
of one foot of intermediate cover."
During this inspection, exposed waste was observed on top of Phase 4A. Several stockpiles of soil from the cleaning
of the Phase 4A drainage ditch were observed on top of Phase 4, however, they had not been spread out over the
exposed waste. Mr. Beasley stated that he would have the soil spread out. The exposed waste at the top of Phase
4A was also identified in the November 2021 inspection report. On September 23, 2022, Mr. Beasley provided the
Section with a photograph of the stockpiles of soil being spread out on the top of Phase 4A.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
Facility Inspection
1. The facility is fenced and is secured by a locking gate when it is not open for operation.
2. The correct signage is at the entrance of the facility listing the facility name, permit number and emergency contact
information as well as materials accepted at the facility.
3. The facility accepts waste Monday through Saturday from 8:00 am until 4:45 pm and closed on Sunday.
4. The waste screening and training records were reviewed during this inspection. The permit and operations plan
were not able to be located during at the time of this inspection. Following the inspection, Mr. Beasley stated that
the permit was located and displayed on the bulletin board within the building. During this inspection, it was
recommended that the permit and operations plan be printed out and placed within a readily accessible
binder for easy access.

The perimeter roadways around the active MSWLF and closed CDLF are being properly maintained.
Permanent edge of waste (EOW) markers were observed around the active portion of the MSWLF and closed
CDLF.
During this inspection, the water truck was in use and applying water to the access roads to suppress dust.
Yard Waste
9. The yard waste has been windrowed. Mr. Beasley stated that the yard waste would be ground within the next couple
of months. The grinding contractor has approximately 6-week lead time.
10. A few of the windrows were observed to be closer than recommended. Ms. Thompson stated that the windrows
needed to be adequately spaced to allow for vehicle access in the event of a fire.
11. An area of standing water was observed between two windrows. Ms. Thompson stated during the inspection that
the area should be filled in and graded as needed to shed water away from the area.
Phase 4A MSWLF
12. Phase 4A has reached capacity and is not currently in use.
13. Portions of the southern side slope have not been stabilized. Some portions of the southern side slope had been
stabilized with mulch. Large erosion rills were observed in the stabilized and unstabilized portions of the toe of the
southern side slope. Leachate was found to be flowing from many of the erosion rills along the toe of the southern
side slope. The leachate releases are identified as a continuing violation of the November 2021 Phase 4A
leachate release.
14. Areas of exposed waste were observed on the top of Phase 4A. Several stockpiles of soil from the cleaning of the
drainage ditch at the toe of the southern side slope were observed on top of Phase 4A. Ms. Thompson stated that
the exposed waste needed to be covered as soon as possible. Mr. Beasley sent the Section a photograph on
September 23, 2022 of the stockpiles of soil being spread out on the exposed waste.
Phase 5 MSWLF
15. Phase 5 has not been in use since the fire that was reported to the Section on August 3, 2022. The area where the
fire had occurred had been properly covered.
16. Exposed waste was observed along the eastern side slope of Phase 5. The western side slope was actively being
covered, graded, and seeded during this inspection. Mr. Beasley stated that they were working their way around the
landfill to make sure all waste was covered. Ensure that all waste is covered, the side slopes properly graded
and stabilized to prevent erosion. Repair areas as needed.
Phase 6 MSWLF
17. The working face of Phase 6 was small and compact. The working face was actively being covered during this
inspection. Mr. Beasley stated that photographs are being taken to document that the rain tarp is being pulled back
and MSW placed as the "fluff' layer adjacent to the liner, during the advancement of the waste in Phase 6.
