PURPOSE OF SITE VISIT: Comprehensive Compliance Inspection STATUS OF PAST NOTED VIOLATIONS: None OBSERVED VIOLATIONS: A. Permit to Operate, Attachment III, Part VII (15) & (16), “A responsible individual trained and certified in facility operations must be on-site at all times during all operating hours of the facility, in accordance with G.S. 130A-309.25. Only personnel who have been trained in accordance with the approved training program in the Operation Plan shall participate in collection activities.” At the time of this inspection, no certified individual was on-site during operating hours. The facility staff on-site at the time of this inspection had no record of completion of Hazardous Waste Management training or record of completion of the HHW training program outlined in the 2019 Ecoflo Wake County HHW Operational Plan, page 9-10. Ensure staff have necessary training and documentation maintained in on site records. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 B. Permit to Operate, Attachment III, Part VII (19), “Materials shall be stored in the HHW collection facility so as to not obstruct the movement of personnel, fire protection equipment, spill control equipment, and decontamination equipment during an emergency.” At the time of this inspection, a pallet holding a large cardboard box containing 5-gallon paint buckets and other miscellaneous HHW was observed obstructing the entrance door to the chemical storage building located on the east side of the outdoor collection area. A clear path and/or adequate space must be maintained between HHW containers and in entry/exit ways so as not to obstruct the movement of emergency, fire, and decontamination personnel and equipment. C. Permit to Operate, Attachment III, Part VII (21), “The date upon which each period of accumulation begins shall be clearly marked and visible on each container. Each container shall be labeled or marked clearly with the words "Hazardous Waste" unless the container separately holds recyclable material. Waste shall not be stored for greater than one year (365 days). HHW shall be transported off-site for recycling, treatment and/or disposal.” At the time of this inspection, multiple collection drums and vessels containing various HHW were not labeled or marked clearly with the date upon which accumulation began or with the words “Hazardous Waste”. Unlabeled drums and vessels pose potential risk to health and safety of facility personnel and visitors. ADDITIONAL COMMENTS: This facility is permitted to receive Household Hazardous Waste (HHW) generated within Wake County, or in accord with an agreement, from other counties. Types of HHW accepted at this facility include propane tanks, florescent light bulbs, batteries, yard and garden products, paints and solvents, household cleaning products, and various other miscellaneous HHW. Several additional solid waste management amenities are located within the adjacent multi-materials structure, including collection areas for electronic waste, pallets, white goods, oil and oil filters, antifreeze, and scrap metal. 1. Wake County contracts with Ecoflo to manage the operations of the HHW facility. 2. The facility was adequately secured by gates, chains, berms, fences, and other security measures approved by the Section to prevent unauthorized entry. Signs were posted at the entrance to the facility stating the hours of operation and other pertinent information. 3. Facility permit and operations plan were available on-site and were reviewed with the Solid Waste Director. Ensure current permit and operations plan are printed and kept on-site. 4. During this inspection, daily logs of received materials, waste characterization records, and manifests were observed to be sporadic and incomplete. Ensure records of the amount of HHW received at the facility, including daily logs of waste received and origins of the loads are kept up to date and on-site. Waste characterizations should be completed for every load received. 5. Digital photographs were taken during this inspection. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
