Dear Ms. Byrd:
On August 16, 2022, Charles Gerstell, representing the State of North Carolina, Division of Waste
Management Solid Waste Section (Section), inspected the above referenced facility for compliance
with North Carolina solid waste statutes and rules. Wilkes County was found in violation of 15A North
Carolina Administrative Code 13B .1626(2)(b), .1626(7), and .1626(11). As a result of these
violations, a Notice of Deficiency was issued to Wilkes County on August 23, 2022.
A follow-up inspection of the facility on September 9, 2022 found the violations of 15A NCAC
13B .1626(2)(b) and .1626(11) had been resolved. The inspection also found the majority of erosion
on the east slope had been repaired, and facility staff were actively working on repair of the slope. All
exposed portions of the geonet composite drainage layer had been covered with soil. Ms. Byrd stated
the Construction Quality Assurance Report would be submitted upon conclusion of repairs. Therefore,
compliance with the remaining violation of .1626(7) was considered in progress.
A Quality Assurance Report was submitted to the Solid Waste Section on September 19, 2022 for
repairs to the eastern slope. Review of the submittal found the slope investigation demonstrated the
cover repair met, or exceeded, the regulatory requirements for protective cover in the area of Phase 5
impacted by extreme erosion. It was further determined that waste placement activities could proceed
within the repair area when needed.
This letter serves to confirm that the requirements of the Notice of Deficiency have been satisfied and
