PURPOSE OF SITE VISIT: Follow-up Compliance Inspection
STATUS OF PAST NOTED VIOLATIONS:
A. 15A NCAC 13B .0405 (a) (10), “Windblown waste: Site staff shall conduct daily inspections for windblown waste on the site property. Windblown litter from the site operations discovered during the daily inspections or observed on adjacent properties shall be picked up and containerized for disposal by the end of each

operating day, unless the landowner of the adjacent property denies access to the site staff. The site shall prevent waste from being blown outside the waste handling areas by the wind, using methods such as: a) Requiring that vehicles entering and leaving the site keep waste covered; b) Providing skirts, such as rubber belting or brushes, around the top of chutes to minimize the space between the chute and the hauling trailer at sites with chutes and hoppers; or c) Preventing waste from leaving the site using methods such as fencing, netting, or diking.
UNRESOLVED: Windblown waste has collected in the grass along the northern exterior facility fencing, around the employee parking area, in the soil along the transfer trailer bay access road at both entry and exit points, and ground into the soil in the transfer truck parking and repair area. Inside the transfer station, waste was again observed in the fire hose pits and behind and on top of the push walls. On 6/24/22 Mr. Roy Baldwin, in response to the previous inspection, emailed a picture to the Section showing all windblown waste in the riprap along the eastern
wall of the transfer station had been cleaned up. During this inspection, it was discovered the windblown waste in this area had not been cleaned up, but that new plastic sheeting had been laid down over the existing waste to give the illusion it had been cleaned up. Plastic sheeting was also installed over the chain link fencing along the southern wall of the transfer trailer bay, but waste was observed escaping this enclosure and collecting on the ground outside the fencing. Large swarms of house flies were present in this area and along the entire length of the transfer trailer loading bay fencing. At the end of each day of operation, all windblown material resulting from the operation shall be collected and disposed of or containerized by the owner or operator. All windblown waste MUST be picked up and disposed of properly. A rake is effective in getting up the smaller pieces of waste. Soil in the transfer truck parking and repair area containing ground-up waste should be excavated and disposed of properly. Subsurface soils in this area need to be evaluated for contamination.
OBSERVED VIOLATIONS: B. 15A NCAC 13B .0405 (b), “Water that comes into contact with solid waste is leachate and shall be collected from the site for disposal to an approved facility or discharged directly from the site into a sanitary sewer line.” During this inspection, pools of leachate had accumulated on the floor of the transfer station tipping floor. Dirt and waste had also accumulated on and around the leachate drains in the transfer trailer loading bay. Collection vehicles and transfer trailers had tracked the accumulated leachate and dirt outside of the transfer station and transfer trailer loading bay, creating a sludge which coated the pavement outside of the collection system. Waste had fallen off loaded transfer trailers leaving the transfer trailer loading bay and appeared to have been run over. The waste was observed accumulated on the soil adjacent to the trailer cover area. Grates and drains should be clear of waste and debris and maintained in free-flowing condition. The accumulated sludge outside the transfer station and transfer trailer loading bay must be scraped up and disposed of. Measures to prevent the accumulation and discharge of leachate outside the WTS must be put in place and include more frequent cleaning if necessary. C. 15A NCAC 13B .0405 (c), “All vehicles and containers being used for the temporary storage of solid waste shall be maintained to be leak resistant in accordance with rule .0105 of this Subchapter, or shall be stored so that any leachate from the vehicles or containers will be collected to prevent the release of leachate to the environment.” During this inspection, multiple collection vehicles waiting to dump waste onto the transfer station tipping floor were observed actively leaking leachate onto the access road. Leachate was then running down the access road and accumulating in a low-lying area of the road. Drivers and employees should be aware that the leachate should be managed within the collection system. D. 15A NCAC 13B .0104 SOLID WASTE STORAGE

(a) The owner or occupant of any property, unless exempted from the rules of this Subchapter in accordance with G.S 130A-294(b), shall be responsible for the sanitary storage of all solid waste accumulated on the property. (b) Unless another type of container is required by the unit of local government, garbage shall be stored in durable, rust-resistant, nonabsorbent, watertight, rodent proof, and cleanable containers with a close-fitting cover that is impervious to flies.
(c) Refuse shall be stored in durable containers that are consistent with the requirements of the unit of local government. (d) All solid waste shall be stored using safe and sanitary practices for the preservation of the public health and welfare and the environment that prevents the generation of leachate, the attraction of vectors, the release of odors, and the release of waste or leachate to the environment.
During this inspection, multiple City of Raleigh plastic rolling garbage bins were being stored adjacent to the facility access road to the south of the transfer station building. These bins were stored uncovered and contained waste and leachate. The contents of the bins had leaked onto the surrounding dirt and the entire dirt area was covered with waste and numerous dark stains. These containers and any impacted soils should be removed and disposed of properly, and subsurface soils evaluated for possible contamination.
ADDITIONAL COMMENTS
1. The facility operating hours are Monday through Saturday from 6:00 am to 3:00 pm. 2. Signs stating emergency information, facility name, permit number, and other required information are installed at
the facility entrance gate and adjacent to the facility scale. 3. The interior roadways are made of all-weather concrete construction. Several areas of cracked concrete were observed within the roadway and apron. The cracked areas should be repaired/replaced as needed so that the flow
of traffic has not been impeded. The underlying soil may need to be tested for possible contamination. 4. The northwestern corner of the exterior metal sheeting of the transfer station had been damaged. This damage was identified in the Transfer Station Assessment Report. The damage does not appear to affect the structural integrity of the facility. The metal sheeting should be repaired as recommended in the Transfer Station Assessment Report. 5. The steel plating along the push walls and within the transfer trailer loading bay have been damaged and are peeling away from the wall in several places. The damage to the steel plating was also identified in the Transfer Station
Assessment Report. It is recommended that the steel plating be either repaired or replaced so that they function properly, and waste does not get caught behind the steel plating. 6. Scrap metal waste adjacent to the tipping floor apron is being stored uncovered and has collected windblown waste and sediment. Ensure all metal waste, windblown waste, and sediment is removed from this area and properly disposed of.
7. The stormwater drainage area in the southeastern section of the facility grounds adjacent to the access road contains a screen surrounding the drain which is clogged with waste and sediment. Stormwater mixed with windblown waste has accumulated in this area to form a large stagnant, mud-filled puddle. Windblown waste and sediment need to be removed from the screen and necessary repairs made to ensure the drain is functioning as designed. 8. A large mound of soil topped with vegetation adjacent to the southeastern stormwater drain contains mixed waste within the soil. Facility staff did not know the purpose of the mound of soil. Ensure the mound of soil and mixed waste is removed and disposed of properly. 9. Waste and sediment were observed in the grates over and within the leachate drains. The leachate drains are connected to the City of Raleigh wastewater system via a pumping system. The pumping system is inspected quarterly. Ensure that the waste is removed from the leachate drains so that the drains function properly.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

10. The concrete near the western leachate drain of the transfer trailer loading bay had been damaged. A steel plate had been placed over the drain so that the transfer trailers and vehicles could leave the loading bay. The damage to the western leachate drain was identified in the Transfer Station Assessment and is scheduled to be repaired. 11. A water leak in the water line near the western end of the transfer trailer loading bay identified in the previous inspection had been fixed. The leaking hydrant was removed, a new hydrant has been ordered, and the facility is currently waiting for the vendor to deliver and install it.
12. Waste had accumulated on the ground outside the loading bay along the area where the loaded trailers are covered. Waste was observed falling out of the trailers leaving the loading bay. The waste was being driven over by the trucks. Waste that falls out of the trailers should be picked up and returned to the WTS. This appears to be an ongoing issue. The impacted soils in this area should be removed and subsurface soils evaluated for contamination. 13. A plan must be submitted to the Section for the soil removal and sampling of the areas impacted by the leachate from leaking containers and garbage accumulation. Within 5 days receipt of this report, please contact Perry Sugg at Perry.sugg@ncdenr.gov for guidance on the plan requirements and sampling protocols. After Section approval of the plan, the plan shall be initiated within seven (7) business days. A summary regarding the soil removal and sampling event should be submitted to the Section within ten (10) business days of receiving the analytical results and completing the requirements of the approved plan. 14. Temporary measures should be installed to ensure areas/items identified as needing repair or replacement in the Transfer Station Assessment Report function as designed and maintain operational compliance until permanent repairs are completed. 15. All waste shall be removed from the tipping floor, truck loading bays, behind push walls, and from the facility grounds by the end of each day of operation and disposed of properly. 16. The facility should be cleaned in accordance with 15A NCAC 13B .0405 (a)(11). 17. Corrective measures are necessary as a result of this inspection and should be complete within 30 days receipt of this report. 18. Digital photographs were taken during the inspection.
