Any soils used for cover at the site shall meet unrestricted use standards for soils as defined in G.S. 130A-310.65. " During the inspection performed on August 31, 2022, landfill side slopes were observed to have inadequate soil cover. Therefore, T & L Grading, Inc. is in violation of 15A NCAC 13B .0566(3). Page 1 of 6 FACILITY COMPLIANCE INSPECTION REPORT D_E Q�� Division of Waste Management NORTH CAROLINA OepaNnent M Environm.nbl puelily Solid Waste Section B. 15A North Carolina Administrative Code 13B .0566(10)(a) states: "Open burning of solid waste is prohibited, unless approval has been obtained from the Division, the local government, and the Division of Air Quality in accordance with 15A NCAC 02D .1900 prior to any burning activity. " During the inspection performed on August 31, 2022, the waste at the working face of the landfill and several piles of mulch on top of the landfill were on fire and smoldering. Therefore, T & L Grading, Inc. is in violation of 15A NCAC 13B .0566(10)(a). To achieve compliance with the violations listed above, actions must continue to ensure that the fire is completely extinguished. Immediately discontinue acceptance of waste until the fire has been completely extinguished. Notify Kim Sue, Environmental Senior Specialist, once the fire has been extinguished and it is deemed safe to work within the landfill area. Within 30 days from the notification to the Environmental Senior Specialist, the entire waste area must be covered with a minimum of 6-inches of earthen material as required by 15A NCAC 13B .0566(3). C. 15A North Carolina Administrative Code 13B .0566(10)(d) states: "The owner or operator shall provide verbal notification to the Division of fires that occur at the site within 24 hours of the fire and shall submit written notification to the Division within 15 days of the fire. The notification shall include the site name and permit number; the date and time of the fire; actions taken by the owner or operator in response to the fire; the cause of the fire; the location and size of the fire; the type and amount of waste that caught fire; a plan of action to prevent fires in the future; the name and title of the person submitting this information; and the date the information is submitted. " Mr. Whitesides did not provide verbal notification to the Division for the fire that occurred on August 27, 2022, nor has a written notification been received by the Division within 15 days of the fire. Therefore, T & L Grading, Inc. is in violation of 15A NCAC 13B .0566(10)(d). To achieve compliance, submit the notification for the fire that occurred on August 27, 2022, notify the Division verbally within 24 hours and submit a written notification within 15 days of any fires that may occur during the operation of this facility. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1. This facility is a Land Clearing and Inert Debris landfill for the disposal of land clearing waste, inert debris, untreated wood, and yard trash and requiring a disposal area of less than two areas. 2. The inspections were performed due to a fire reported to the Solid Waste Section on 8/30/2022 by the Division of Air Quality. 3. On August 31, 2022, the waste at the working face of the landfill and several piles of mulch on top of the landfill were on fire and smoldering. Please see the Observed Violations section of this report. 4. A fire lane was observed around the perimeter of the landfill. According to Mr. Whitesides he was directed by the local Fire Department and Forestry Service to construct the fire lane. The local Fire Department and Forestry Service Page 3 of 6 FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section responded to the fire on August 27, 2022. Mr. Whitesides stated that the piles of mulch located on the landfill spontaneously combusted. During the August 31, 2022, inspection Mr. Whitesides was informed to cease accepting waste until the fire was completely extinguished. He was also instructed to cover the waste with soil when deemed safe. Mr. Whitesides stated he was coordinating additional equipment to the site to start covering the landfill with soil. A follow-up inspection was conducted on September 2, 2022. Mulch was still observed smoldering. Mr. Good was pushing soil up against the base of the one remaining smoldering pile of mulch, which was approximately 20 feet high. Mr. Good was spreading the smoldering mulch pile in preparation for soil cover. Approximately 4-5 loads of new waste were observed disposed of on the working face. While on -site a load of waste was turned away. The facility staff were again informed to cease accepting waste until the landfill fire was completely extinguished. A follow-up inspection was conducted on September 13, 2022. The western side slope and area where the smoldering mulch pile was spread out was covered with soil. No smoke was observed during the inspection. Mr. Good stated that approximately 1-1 '/2 feet of soil had been applied on the flat areas and 3 feet or more had been applied on the side slopes in the area where the mulch piles were located. Some exposed waste in the landfill needed additional soil. Mr. Good stated he would be applying additional soil. Access to the site is secured by a gate to prevent unauthorized access. 10. Ensure an operator is on duty at all times while the site is open for public use to assure compliance with operational requirements and to prevent acceptance of unauthorized wastes. 11. Access roads within the facility were adequately maintained. 12. Reinstall any permanent waste boundary markers that were damaged due to the fire to ensure the disposal area of two acres is maintained. 13. Solid waste in the landfill shall be compacted. Slopes shall not exceed a ratio of three horizontal to one vertical at any time per 15A NCAC 13B .0566(2). Please contact me if you have any questions or concerns regarding this inspection report.
