Site is recorded in the Edgecombe County, North Carolina Register of Deeds, Book 1324, Page 396. Edgecombe Co. Parcel number is 387313920000.Total property is 319.4 acres. The actual compost operation is approximately 27 acres. This Permit to Operate (PTO) expired March 04, 2020. John College Searched the Laserfiche database and no renewal documents or new PTO found. Mr. Smith and his consultant are in contact with DWM permitting staff. See item #1 on page 2 of this report. PURPOSE OF SITE VISIT: Partial Facility Compliance Inspection of a Large Type IV Compost Facility. STATUS OF PAST NOTED VIOLATIONS: None OBSERVED VIOLATIONS: None FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 4 ADDITIONAL COMMENTS: 01 - Per Last Inspection: The Permit to Operate (PTO) for this facility is a Large Type 4 Compost Facility and was issued on August 19, 2016 and expired on March 04, 2020. No later than November 04, 2019, Permittee must have submitted a request for a permit review and must update pertinent facility plans. On the last inspection, Jason Smith told John College the permit renewal information has been sent in. John College instructed Jason Smith to contact the permitting section to check on this permit’s status on the last inspection report dated December 11, 2020. No new permit or renewal documents were found in Laserfiche by John College on April 21, 2021. Covid-19 may have slowed the PTO process. Keep operating under your August 19, 2016 PTO, but also keep checking with permitting staff on the status of the renewal of your PTO. Mr. Smith and his consultant are in contact with DWM permitting staff. Last contact email was dated 3/16/2022 and stated: The site owner is in compliance with our rules for the permit renewal because they have submitted an application for renewal, even when the permit has expired. In accordance with 15A NCAC 13B .0202 (d), “When a permit applicant submits a complete application for a permit to the Division prior to the expiration date of the existing permit for the facility, including the payment of an annual fee and permit application fee if required by G.S. 130A-291.1 or 130A-295.8, the existing permit shall not expire until a decision on the permit application is made by the Division.” 02 - Facility has several signs with required information. 03 - Facility has fencing and locking gates/cables for security. 04 - Roads are made of All-Weather construction and maintained well. 05 - All windrows (Stored feedstock, Active compost & Finished product) do not exceed size requirements. 06 - Facility has several windrows stockpiled at the front to be used for land application. Need to apply soon. The curing pad is full and room to work the compost into windrows is getting scarce. 07 - All Finished product is permitted to be land applied. 08 - No leachate issues noted during this inspection on the compost site. 09 - The leachate pond may need to be pumped soon to ensure freeboard compliance. DWR jurisdiction. 10 - There continues to be very little of non-conforming waste left into the feedstock piles or the active compost piles. 11 - Temperature records and other records were not reviewed during this partial facility inspection. 12 - Calibration of temperature probe records were not reviewed during this partial facility inspection. Facility can calibrate probes with the ice water method. 32 degrees. 13 - Digital pictures were taken during this inspection and some are attached to this report. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
