OBSERVED VIOLATIONS:
A. 15A NCAC 13B .0564 (6) (b), "Buffer Requirements: A site shall maintain the following buffer
requirement: 100 feet from the waste boundary to property lines, residential dwellings, commercial or
public buildings, and potable wells."
Based on the Notification that was received by the Section in December 2001, the LCID is located on Parcel ID
05H02199F. A review of the Johnston County tax records, the inert debris area has crossed over onto Parcel ID
05H02203T. Although both parcels are owned by Bobby and Nancy Hardee, the parcel line is considered to be a
property line. It is recommended that the parcels be combined, or a separate parcel be created for the LCID and
inert debris area itself, so that the buffer requirements are met.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
A copy of the new LCID rules, which became effective on January 1, 2021, was provided to Tyler and Drew Hardee
during the August 31, 2022 Inspection. Please read through the rules and contact me if you have any questions. Based on
rule 15A NCAC 13B .0563 (6), within 5 years of the effective date, notified LCID landfills will need to be properly closed
or obtain a permit from the Division of Waste Management.
1. The access road is of all-weather construction and appears to be properly maintained.
2. 15A NCAC 13B .0201 (g), "Disposal area boundaries for landfills permitted in accordance with Section
.0500 or .1600 of this Subchapter shall be delineated with stationary markers affixed to the ground. The
markers shall be of height and spacing so that they are distinguishable from the surrounding landscape,
and so that the adjacent markers are visible when standing at a marker." Edge of waste (EOW) markers
were not visible during this inspection. Permanent, clearly visible edge of waste markers must be established
at the site, showing the under two -acre disposal boundary. During the August 31, 2022 inspection, Drew
Hardee stated that they had contacted their surveyor to install the EOW markers; however, he was backed up with
other jobs for the next few months. Please keep the Section informed as to when the EOW markers are installed.
3. The waste stream of the LCID area was identified to be relatively clean during the August 11, 2022 inspection,
with a few pieces of plastic piping and dimensional lumber. Tyler Hardee was notified of the unacceptable wastes
observed and that the unacceptable wastes would need to be removed. During the August 31. 2022 inspection, no
unacceptable wastes were observed.
4. 15A NCAC 13B .0564 (7), "The site shall establish and maintain an access road around the waste boundary
for access by emergency or fire -fighting vehicles and equipment." An access roadway has not been established
around the LCID.
5. 15A NCAC 13B .0566 (2), "Solid waste in the landfill shall be compacted. Slopes shall not exceed a ratio of
three horizontal to one vertical at any time." The side slopes of the inert debris area were identified to be nearly
vertical and uncovered during the August 11 and 31, 2022 inspections. At the time of the August 31, 2022
inspection, some of the ground LCID material had been used as cover and for stabilization of the inert debris side
slopes. Tyler Hardee asked during the August 31, 2022 inspection, if they would be able to cover the side slopes
with dirt and slope the side slopes into the drainage area to meet the three horizontal to one vertical ratio. Tyler
Hardee stated that they had installed the drainage feature, it was not natural. Mr. Hammonds stated that he would
contact Division of Water Resources (DWR) to determine the status of the drainage area and if it could be partially
filled in. Please contact Colleen Cohn or Cherry Smith with DWR at (919) 791-4200, to determine the status
of the drainage area and any procedures or authorizations needed to slope the inert debris area into the
drainage feature.
6. During the August 11, 2022 inspection, the northern and eastern side slopes of the LCID were found to be partially

covered and steeper than the three horizontal to one vertical ratio. After the August 11, 2022 inspection, Tyler
Hardee was informed that the side slopes of the LCID were partially uncovered and steeper than three horizontal
to one vertical. Tyler Hardee stated that the area would be fixed prior to our next meeting. At the time of the
August 31, 2022 inspection, the side slopes of the LCID had been covered and properly sloped.
7. At the time of the August 11, 2022 inspection, the LCID was being excavated, ground, screened and sold.
Sometime prior to the August 31, 2022 inspection, the excavation, grinding, and screening of the LCID waste had
been completed.
8. Digital pictures were taken during the inspection.
9. Corrective measures are necessary at this facility. Measures to bring the facility into compliance must be
completed within 30 days of receipt of this report. The Solid Waste Section will conduct a follow-up
inspection in 30 days to ensure issues noted in this inspection report have been addressed.
