Current status of the Land Clearing and Inert Debris Landfill Notification is OPEN PURPOSE OF SITE VISIT: Partial Inspection STATUS OF PAST NOTED VIOLATIONS: A. Status – Resolved: 15A NCAC 13B .0564(9)(a) cited for failure to maintain minimum buffer requirements: 50 feet from the waste boundary to all surface waters of the state as defined in G.S. 143-212. The landfill currently has an adequate buffer between the edge of waste and all surface waters. B. Status – Resolved: 15A NCAC 13B .0566(4) cited for failure to apply adequate soil cover monthly, or when the active area reaches one acre in size, whichever occurs first. The north slope of the landfill which was previously uncovered has been covered with adequate soil and a good grass cover has been established on part of this slope.

C. Status – Not Resolved: 15A NCAC 13B .0566(8) cited for failure to adequately secure the facility by means of gates, chains, berms, fences, etc. to prevent unauthorized access except when an operator is on duty. An attendant shall be on duty at all times while the landfill is open for public use to assure compliance with operational requirements and to prevent acceptance of unauthorized wastes. During the inspection the landfill was not secured. To achieve compliance the facility shall be secured by means of gates, chains, berms, fences, etc. to prevent unauthorized access except when an operator is on duty.
NEW OBSERVED VIOLATIONS:

ADDITIONAL COMMENTS On September 9, 2022, Chuck Kirchner conducted a partial inspection of the Adcock Grading and Demolition LCID Landfill on Mendenhall Road in Trinity, Randolph County. 1. The Adcock Grading and Demolition land clearing and inert debris (LCID) landfill is located on Mendenhall Road. Mr. Adcock’s residence is located on the property, near the LCID landfill. 2. The LCID landfill is approximately 1.25 acres in size. 3. Mr. Adcock had previously stated that the LCID landfill is primarily used by his grading and demolition company. 4. Mr. Adcock previously stated he removes logs from land clearing debris (LCD) and stores them separately to cut
for firewood.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

5. Two small piles of logs were observed near the landfill during this inspection. 6. A small pile of mulch was observed located near the logs.

company were observed parked atop the LCID landfill area. The footprint of the LCID landfill shall not be used as a staging area as by doing so the facility cannot meet the cover and vegetation requirements in 15A NCAC 13B .0566(4) which states “Areas that will not have additional wastes placed on them for three months or more, but
where final termination of disposal operations has not occurred, shall be covered with no less than one foot of soil cover sloped to direct the flow of surface water from the landfill, and stabilized with vegetative ground cover or other stabilizing material. The Division may require further action to correct any condition that the Division
determines may be injurious to the public health, or a nuisance to the community.” 8. A small pile of used asphalt is stored on the south side of the landfill. Please see the regulation regarding speculative accumulation: NC General Statue 130A-309(C)(1).

9. Side slopes have been covered with soil since the last inspection. Continue to seed and mulch slopes until all remaining bare areas are stabilized with a vegetative ground cover. 10. Per 15A NCAC 13B .0566(3), “Solid waste shall be restricted to the smallest area feasible and compacted as densely as practical into cells.” Ensure all waste brought into landfill is compacted. 11. Very little LCD was observed on the landfill during this inspection.
12. Some mulched LCD material was observed on top of the landfill. 13. The facility has an all-weather access road. 14. This site must close or obtain a permit by January 1, 2026. 15A NCAC 13B .0563(6) states “Within five years of the readopted effective date of this Rule, the owner or operator of a notified LCIDLF that was not closed prior to the readopted effective date of this Rule shall comply with the requirements of this Rule, or shall close the notified LCIDLF in accordance with Rule .0567(b) of this Section, except that the required
notification of closure is not required to be certified. For the purpose of this Rule, "notified LCIDLF" means a site that was not required to obtain a permit from the Division prior to the readopted effective date of this Rule because the site was designed and constructed to be two acres or less in size, and was required to record a notification for the site with the Register of Deeds' office and submit the notification to the Division.” The following link is to the regulation concerning this rule: 15A NCAC 13B .0563.
