Resolved: 15A NCAC 13B 0.563(1) states, “the site shall accept only yard waste and inert debris waste for disposal”. This past noted violation was originally observed during the inspection on August 26, 2022. Since that time, the unacceptable construction and demolition debris has been removed from the LCID landfill. Mr. Cain provided the landfill tickets to confirm the disposal in a solid waste facility permitted to accept the waste. The C&D material has been removed from the site. Photo of the area of the LCID that painted brick and painted concrete had been stored. All of the painted material has been removed along with the metal. B. Corrective Measures in Progress: 15A NCAC 13B .0566(2) states, “solid waste in the landfill shall be compacted. Slopes shall not exceed a ratio of the three horizontal to one vertical at any time”. During the original inspection on August 26, 2022, it was noted that the LCID side slopes exceeded the three horizontal to one vertical ratio. During this follow up inspection the issue and corrective actions required were discussed with Mt. Cain. Mr. Cain. Stated that he was receiving equipment to begin working on the grading and FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 3 of 4 soil cover on the landfill side slopes on 9/9/2022. C. Corrective Measures in Progress: 15A NCAC 13B .0566(14) states, “a sign shall be posted at the site entrance showing the site contact’s name and phone number, the permit number, emergency contact information, and the waste types accepted for disposal at the site.” During the original inspection on August 26, 2022, a sign was not observed on site. Mr. Cain stated that his previous sign had been destroyed and that he was working on acquiring a new sign to install at the entrance of the LCID Landfill. OBSERVED VIOLATIONS: N/A ADDITIONAL COMMENTS 1. All photos included within this report were taken by Robert Pike on August 26, 2022. 2. The site is a notified land clearing and inert debris (LCID) landfill. 3. The landfill is known as Michael Cain Caleb Grading Company LCID Landfill 4. A discussion was held with Mr. Cain to provide technical assistance regarding the permitting process and application for becoming a permitted LCID. Jordan Russ, engineer with the Solid Waste Section, discussed the permit application process and the permit requirements with Mr. Cain. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
