OBSERVED VIOLATIONS: A. 15A NCAC 13B .0563(1) states, “the site shall accept only yard waste and inert debris waste for disposal”. Michael Cain is in violation of 15A NCAC 13B .0563(1) for accepting construction and demolition debris in the LCID landfill. Painted brick, painted concrete, metal, and demolition debris was observed to have been placed in the landfill. To achieve compliance the construction and demolition debris must be removed from the landfill and dispose the waste in a solid waste facility permitted to receive the waste. B. 15A NCAC 13B .0566(2) states, “solid waste in the landfill shall be compacted. Slopes shall not exceed a ratio of the three horizontal to one vertical at any time”. Michael Cain is in violation of 15A NCAC 13B .0566(2) for having the slopes of the landfill exceed a ratio of FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 4 three horizontal to one vertical. The landfill slopes were observed to be near vertical and appeared to be uncompacted. To achieve compliance the landfill slide slopes must be graded to not exceed the ratio of three horizontal to one vertical and the solid waste must be compacted in the landfill. C. 15A NCAC 13B .0566(14) states, “a sign shall be posted at the site entrance showing the site contact’s name and phone number, the permit number, emergency contact information, and the waste types accepted for disposal at the site.” Michael Cain is in violation of 15A NCAC 13B .0566(14) for not having a sign posted at the entrance of the LCID landfill. To achieve compliance, install a sign with the required information at the entrance of the LCID landfill. ADDITIONAL COMMENTS 1. All photos included within this report were taken by Robert Pike on August 26, 2022. 2. The site is a notified land clearing and inert debris (LCID) landfill. 3. The landfill is known as Michael Cain Caleb Grading Company LCID Landfill 4. The landfills footprint still appears to be inside the two-acre limit. 5. Adequate soil for cover was observed onsite. 6. Soil cover was observed placed on waste on top of the landfill; however, the waste on the landfills side slopes were not compacted or covered. Please see the Observed Violations section of this report. 7. The facility has an all-weather access road. 8. Ensure that only yard waste and inert debris is accepted at the landfill. 15A NCAC 13B .0101(28) defines inert debris as “"Inert debris waste" means inert debris that consists solely of asphalt, cured concrete, brick, concrete block, gravel, and rock. Inert debris waste shall not contain chemical adhesives or sealants, or lead-based paint.” 15A NCAC 13B .0101(69) defines yard waste as “"Yard waste" means land-clearing waste and yard trash”. Please see the Observed Violations section of this report. 9. This site must close or obtain a permit by January 1, 2026. 15A NCAC 13B .0563(6) states “Within five years of the readopted effective date of this Rule, the owner or operator of a notified LCIDLF that was not closed prior to the readopted effective date of this Rule shall comply with the requirements of this Rule, or shall close the notified LCIDLF in accordance with Rule .0567(b) of this Section, except that the required notification of closure is not required to be certified. For the purpose of this Rule, "notified LCIDLF" means a site that was not required to obtain a permit from the Division prior to the readopted effective date of this Rule because the site was designed and constructed to be two acres or less in size, and was required to record a notification for the site with the Register of Deeds' office and submit the notification to the Division.” The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
