The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
1. On -site August 31, 2022, to partially review facility records/certifications, observe construction of Cell 7 of the
Municipal Solid Waste Landfill (MSWLF) and Phase 7 of the Construction and Demolition Landfill (CDLF), observe
facility mowing maintenance efforts, and inspect the White Goods/Scrap Metal area, Treatment and Processing
(T&P)/Wood Grinding area, the active MSWLF, and the active CDLF. Participants from the facility included Dane
Pedersen, Solid Waste Director, Buncombe County, and Kristy Smith, Engineering Solid Waste Manager, Buncombe
County.

3. The White Goods and Scrap Metal area appeared to be maintained at the facility. As discussed on -site, continue to
ensure white goods remain upright until refrigerants are removed by the facility's contractor. The facility currently
contracts with Biltmore Iron and Metal Co. (BIMCO) for white goods and scrap metal removal/processing from the
facility as necessary.
4. The T&P/Wood Grinding area appeared to be maintained. Wood grinding in the T&P area is currently performed by
facility personnel as necessary. Continue to ensure facility personnel monitor for unpermitted waste in this area. As
discussed on -site, continue to maintain fire breaks and lanes in the T&P/Wood grinding area as needed.
5. Maintenance mowing for established ground cover at the facility was observed during this inspection. Continue to
conduct ground cover mowing maintenance efforts at the facility as necessary.
6. Waste screening records for the MSWLF facility were reviewed from 1/4/2022 through 8/23/2022. Waste screening
records for the CDLF facility were reviewed from 1/2/2022 through 8/19/2022. Waste screening records appeared to be
maintained. As required, continue waste screening efforts at the MSWLF and CDLF facilities and maintain waste
screening forms for each facility.

7. Alternative Cover Material (ACM) records for spray applied mortar coating (Posi-Shell) application were reviewed for
the months of June, July, and August 2022. ACM records appeared to be maintained and included application location(s),
weather conditions, personnel, and amount used. Continue to maintain records for ACM utilized at the facility.
8. The working face of MSWLF (Cell 6) was inspected and appeared to be maintained. As discussed on -site, continue to
maintain waste screening at the MSWLF working face and ensure any unpermitted waste delivered to this unit is removed
and disposed of properly. Although the covering of waste appeared to be generally compliant, ensure that staff are paying
attention to the areas where alternative cover materials are tied into the soil cover. There was a small area along the right
of the active working face where full coverage was not obtained the previous day.
9. During this inspection, sliver/wedge fill operations at the MSWLF facility were discussed. Per facility personnel and
as observed on -site, sliver/wedge fill operations at the site are at or near completion. As discussed, continue to maintain
vegetative ground cover on the slopes of the MSWLF facility on which the sliver/wedge fill operations occurred.
10. Continue to maintain erosion control measures for the MSWLF facility, including sediment basins, ditch lines, rip -
rap channels, diversion berms, inlet/outlet stabilization structures, vegetative ground cover, etc., as necessary.
11. The working face of CDLF (Phase 6A) was inspected and appeared to be maintained. Continue to maintain waste
screening efforts at the CDLF working face. As discussed on -site, continue to maintain the application of cover for the
CDLF facility per the Operations Plan. An area of recently exposed waste was observed in an area of the C&D landfill
where inactive operations meet the active construction area. It was discussed that the contractor inadvertently dug into the
cover and waste while attempting to remove rock from the area. Please remind all contractors working at the landfill that
if they encounter or uncover waste, it shall be recovered, or excavated and moved to the active working face. Facility staff
sent the Section documentation of waste excavation and application of cover in this area on August 31, 2022.
12. Continue to maintain vegetative ground cover on the slopes of the CDLF facility as necessary.
13. As discussed on -site, continue to ensure any windblown litter in the CDLF facility is collected and properly disposed
of at the end of each working day, including any waste captured in the higher grass in the road ditch line.
14. Continue to maintain erosion control measures for the CDLF facility, including sediment basins, ditch lines, rip -rap
channels, diversion berms, inlet/outlet stabilization structures, vegetative ground cover, etc., as necessary. As discussed,
all equipment entering or exiting the active landfill area should use established roads. The damaged area along the road
ditch line adjacent to the C&D landfill should be repaired immediately.
15. During this inspection, ongoing construction activity was observed for Cell 7 of the MSWLF facility, as well as for
Phase 7 of the CDLF facility. As discussed during this inspection, continue to construct these facilities according to the
approved plans and contact the Section regarding a pre -operative meeting prior to operating either MSWLF Cell 7 or
CDLF Phase 7.
