STATUS OF PERMIT: Notified LCID – Preparing for closure PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: NA OBSERVED VIOLATIONS: 1. 15A NCAC 13B .0567 (b) (2) The owner or operator of a site shall complete the closure activities within 120 days after beginning the closure activities as specified in Subparagraph (1) of this Paragraph. On June 14, 2021, Section staff inspected the N0396 NLCID for closure and it was documented that “Waste no longer being accepted at this NLCID.” In that inspection report, it stated, “Since this facility has accepted its last receipt of waste and begun closure, it now has 120 days to complete closure activities. Inspection date of June 14, 2021, can be used as the start of the 120-day time limit.” Many attempts since that date have been made to confirm closure activities were complete, to acquire the required documentation and engineer certification verifying closure has been completed, in accordance with rule. Upon revisiting on 9/2/2022, closure activities were still not complete and requested documentation still not received by the Section. EOW marker needed on this corner ADDITIONAL COMMENTS 1. David Powell inspecting site for routine comprehensive inspection and to follow up on facility closure. Waste not being accepted at this NLCID. Multiple attempts have been made since last visit to get required documentation for closure of NLCID. Closure activities still occurring onsite. 2. Site has had additional soil cover put on several areas of side slopes. According to Mr. Byrd, they have had an engineering firm come and do soil borings, for final closure documentation, and found that there were some areas which needed additional cover. Onsite staff have been addressing those areas. There is still some soil staged onsite needing to be applied, covered, compacted, and sloped. Once complete, owners can have engineers come out and verify soil cover depths and certify. Be sure all waste is inside the Two-acre notification, with an additional fifty-foot extension in southwest end of NLCID and meet buffers. A map of this should also be submitted showing limits of waste disposal and soil boring locations. A letter to the Section stating that the owners, “Request closure and have completed closure according to Rule 15A NCAC 13B .0567 and will conduct Post Closure Care according to also according to Rule 15A NCAC 13B .0567 for ten years following closure.” In addition, this letter should include the name of the facility, notification number, owners name, return mailing address and contact information and be signed by the landowner. These can be sent via email to david.powell@ncdenr.gov or by mail. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Edge of Waste Markers (EOW) were visible on the corners of the NLCIDLF but one or two have been knocked over, please fix. One should be visible to the next. This will help staff see both limitations when inspecting onsite. Suggest keeping tall white PVC pipe. Some small shrubs/trees also on side slopes need removal. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 4 of 5 4. Concrete crushing has been done and is staged nearby onsite. Section staff have previously explained 75% rule (§ 130A-309.05. Regulated wastes; certain exclusions) and the need for material to be removed otherwise it becomes disposal in previous inspection. Concrete should be utilized on roads and not left staged, 75% is to be used within the year. Concrete crushed and stored, erosion rills visible on side slopes of NLCID, needing repair. 5. Road access is still present around perimeter but may need some maintenance to stay “all weather”. Roads should be of all-weather construction and maintained. 6. Slopes looked good, however, where soil was recently added erosion rills were visible on the slopes. Address cover, sloping and vegetating to meet new closure rules. Then, be sure to vegetate and maintain. Mr. Byrd indicated they will hydro seed once work is complete. Good job. This will provide long term erosion control. Shrubs and trees should not be allowed on the structure and there are post closure care requirements, such as frequent mowing, that will be needed to maintain the structure. Corrective measures are necessary as a result of this inspection. All of these corrective actions should be completed to meet closure and will be confirmed on follow up inspection and should be complete within 45 days’ receipt of this inspection report. Failure to meet the conditions for compliance may result in further Compliance Actions.
