A. 15A NCAC 13B .0203(d) states: “By receiving solid waste at a permitted facility, the permittee shall be considered by the Department to have accepted the conditions of the permit and shall comply with the conditions of the permit.” Permit Condition Attachment III, Part I, Number 5 states in part: “When the landfill is opened for permitted waste activities, an attendant shall be on duty to conduct waste screening, to assure compliance with operational requirements.”
During the inspection no attendant was on duty and a load of LCID material was observed being dumped at the landfill. Therefore, Winfree Road LCID Landfill, Inc. is in violation of 15A NCAC 13B .0203(d) for failure to have an attendant on duty while the landfill was open for permitted waste activities.

To correct this violation an attendant shall be on duty at the landfill anytime the landfill is opened for permitted waste activities. B. 15A NCAC 13B .0566(6) states: “The site shall be secured by barriers such as gates, chains, berms, and fences to prevent unauthorized access. An operator shall be on duty at all times while the site is open for public use to assure
compliance with operational requirements and to prevent acceptance of unauthorized wastes.” During the inspection no attendant was on duty and a load of LCID material was observed being dumped at the landfill. Therefore, Winfree Road LCID Landfill, Inc. is in violation of 15A NCAC 13B .0566(6) for failure to have an attendant on duty while the landfill was open for permitted waste activities.
To correct this violation an attendant shall be on duty at the landfill anytime the landfill is opened for permitted waste activities. C. 15A NCAC 13B .0566(3) states: “All waste shall be covered with no less than six inches of soil monthly, or when the working face reaches one acre in size, whichever occurs first. Any soils used for cover at the site shall meet unrestricted use standards for soils as defined in G.S. 130A-310.65.” Approximately an acre and a half of uncovered LCID was observed at the Winfree Road LCID landfill during the August 30, 2022 facility inspection. Therefore, Winfree Road Landfill, Inc. is in violation of 15A NCAC 13B .0566(3).
To correct this violation, Winfree Road LCID landfill must cover all waste with no less that six inches of soil monthly and reduce the size of the working face to less than one acre in size. A follow up inspection will be conducted in approximately one month to determine if compliance has been achieved.
ADDITIONAL COMMENTS
On August 30, 2022, Chuck Kirchner conducted a comprehensive inspection of the Winfree Road Landfill, Inc. – LCID Landfill on Winfree Road in Summerfield, Guilford County.
1. The facility is a land clearing and inert debris (LCID) landfill, also previously known as the W.W. Dick LCID Landfill. 2. The facility is in operation Monday through Friday 8:00 am to 5:00 pm. 3. Facility gates were observed open during the inspection and no attendant was on site or in the facility office during this
inspection. 4. The facility still appears to be operating in Phase 2. 5. The facility is permitted to receive waste generated within Alamance, Guilford, and Rockingham Counties.
6. The facility is permitted to receive land clearing waste, yard trash, untreated and unpainted wood, uncontaminated soil, inert debris, and (used) asphalt. 7. No composting was observed during this inspection. 8. During the inspection, approximately 1.5 acres of LCID material appeared to be uncompacted and uncovered. Please see the Observed Violations section of this report.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

9. Per 15A NCAC 13B .0566(4), “Areas that will not have additional wastes placed on them for three months or more, but where final termination of disposal operations has not occurred, shall be covered with no less than one foot of soil cover sloped to direct the flow of surface water from the landfill, and stabilized with vegetative ground cover or other stabilizing material. The Division may require further action to correct any condition that the Division determines may be injurious to the public health, or a nuisance to the community.”
10. Excavation, grading, and fill material side slopes shall not exceed three to one (3:1) per the permit (Attachment 3, number 8 on Page 7 of the permit).
11. No open burning is permitted on site. Fires must be reported to the Regional Environmental Senior Specialist within twenty-four (24) hours of the occurrence with a written notification to be submitted within fifteen (15) calendar days of the occurrence.
12. A ready supply of soil shall be available for cover material. An area approximately 3.65 acres west of the landfill is used for borrow material. 13. The waste disposal boundary must be accurately identified with permanent markers which shall be constantly maintained according to Rule 15A NCAC 13B. 0201(g). 14. Logs of certain sizes are removed from land clearing debris to repurpose at the lumber mill according to Mr. Friddle. 15. There was no indication of erosion or runoff. Ensure all disturbed areas are covered by a Sediment and Erosion
Control Plan. 16. Access roads are of all-weather construction. 17. The facility is secured by a locked gate.
