The Notification is described by the deed recorded in BOOK: 1534 PAGE: 459. PURPOSE OF SITE VISIT: Follow-up Inspection to the July 1, 2021 Notice of Continuing Violation STATUS OF PAST NOTED VIOLATIONS A. 15A NCAC 13B .0566 (1), "The site shall only accept those solid wastes that it is permitted to receive." UNRESOLVED: The treated wood and plywood that were observed along the northern access road during the June 30, 2021 inspection had not been removed. The treated wood wastes MUST be removed and properly disposed of. B. 15A NCAC 13B .0566 (2), "Solid waste in the landfill shall be compacted. Slopes shall not exceed a ratio of three horizontal to one vertical at any time." UNRESOLVED: At the time of this inspection, the waste has not been compacted or sloped. The site was identified to be approximately 2.5 acres in size. The waste MUST be compacted and consolidated to under two acres, per the LCID Notification Form. Page 1 of 4 FACILITY COMPLIANCE INSPECTION REPORT D_E Q�� Division of Waste Management NORTH CAROLINA o"' t0E'"�m"""°"""' Solid Waste Section C. 15A NCAC 13B .0566 (3), "All waste shall be covered with no less than six inches of soil monthly, or when the working face reaches one acre in size, whichever occurs first." UNRESOLVED: At the time of this inspection, the waste has not been covered. The waste needs to be compacted and covered IMMEDIATELY. D. 15A NCAC 13B .0564 (6) (b), "The facility shall meet the following buffer requirements ... 100 feet from the waste boundary to property lines, residential dwellings, commercial or public buildings, and potable wells." UNRESOLVED: At the time of this inspection, the waste had not been moved away from the residential parcel, PIN 1200146, which is landlocked by the parcel occupied by the LCID. The waste MUST be moved away from the property line to meet the 100-foot setback. E. 15A NCAC 13B .0201 (g), "Disposal area boundaries for landfills permitted in accordance with Sections .0500 or .1600 of this Subchapter shall be delineated with stationary markers affixed to the ground. The markers shall be of height and spacing so that they are distinguishable from the surrounding landscape, and so that the adjacent markers are visible when standing at a marker." UNRESOLVED: No edge of waste markers were identified were identified during this inspection. Permanent, clearly visible edge of waste markers must be established at the site, showing the under two -acre disposal boundary. This has been commented on in previous reports. F. May 13, 2021 Notice of Violation, "Cease accepting waste at this site until conditions of compliance are met." RESOLVED: During this inspection, no additional new waste was observed. Continue to CEASE accepting waste at the facility until the facility is in compliance. OBSERVED VIOLATIONS None. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS: Based on rule 15A NCAC 13B .0563 (6), within 5 years of the effective date, notified LCID landfills will need to be properly closed or obtain a permit from the Division of Waste Management. 1. 15A NCAC 13B .0566 (6), "The site shall be secured by barriers such as gates, chains, berms, and fences to prevent unauthorized access." During this inspection, the site was not secured by such methods by Mr. Wommack. However, a gate had been installed by CSX railroad across West 1 O'h Street to block access through the railroad property. 2. 15A NCAC 13B .0566 (14), "A sign shall be posted at the entrance showing the site contact's name and phone number, the permit number, emergency contact information, and the waste types accepted for disposal at the site." No signage was posted at the entrance of the site. This has been commented on in previous reports. 3. 15A NCAC 13B .0564 (7), "The site shall establish and maintain an access road around the waste boundary for access by emergency or fire -fighting vehicles and equipment." Only the northern and eastern sides of the LCID were accessible via vehicle during this inspection. It is recommended that the current road also be graded to remove the large ruts and potholes. 4. Land clearing waste was identified to have been pushed into the western adjacent tree line. This land clearing waste MUST be moved away from the tree line. 5. Corrective measures are necessary at this facility. Measures to bring the facility into compliance must be completed within 30 days' receipt of this report. The SWS will conduct a follow-up inspection in 30 days to ensure issues noted in this inspection report have been addressed. 6. Please note that burning of the waste is prohibited and would be in violation of North Carolina Air Quality Rules. 7. Digital photographs were taken during the inspection.
