STATUS OF PAST NOTED VIOLATIONS:
A. 15A NCAC 13B .0203(d): Corrective Actions in Progress. Riverside Stump Dump at Mills River was cited for
storing mulch within fifty (50) feet of the onsite water stream during the August 11, 2022 inspection. Mulch had
been removed from the stream buffer on the south side of the southern access road. However, mulch was still
being stored approximately thirty-six (36) feet from the stream on the north side of the southern access road.
To correct the violation all mulch must be removed from stream buffer by September 15, 2022.

OBSERVED VIOLATIONS:
None
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
1. All photos were taken by Lee Hill on August 29, 2022.
2. The facility is approved to receive stumps, land clearing debris, untreated and unpainted dimensional lumber
and pallets. Yard trash is not accepted at the site.
3. The operating hours for the facility are Monday through Friday, 7:OOAM to 5:30PM, with seasonal hours on
Saturdays, depending on demand.
4. Gates are installed at the entrance and exit of the facility to prevent unauthorized entry.

5. Interior roadways were of all-weather construction and were being maintained at the time of inspection.
6. The finished mulch that was observed being stored within the fifty (50) foot stream buffer on the south side of
the southern access road during the August 11, 2022 inspection had been removed. However, mulch was still
being stored approximately thirty-six (36) feet from the stream on the north side of the southern access road.
After discussions with facility staff, it was agreed upon that all mulch would be removed from the buffer area
by September 15, 2022. Remove all mulch from within fifty (50) feet of the stream by September 15, 2022.

7. Additional stream buffer markers have been installed on the south side of the southern access road to delineate
the buffer area.
8. No unapproved material was observed in the land clearing stockpile at the time of inspection.
