Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Mr. Powell met with Mr. Steve Waters, of Barnhill Contracting, to inspect the site. The purpose of this site visit was to conduct a comprehensive inspection. Site is gated and has all weather road access with proper signage. Entrance, gate and signage. 2. Currently has a small working face, with cones/barrels to guide traffic. Some unapproved waste was visible but minimal. Please remove to appropriate disposal site. Entrance road changes as operations continue on the LCID. Current access road, if maintained properly, should continue to meet rule requirement. Access road was added around current cells, per new rules, but needs mowing. Be sure to ensure its of all-weather construction and maintained accordingly. 15A NCAC 13B .0564 (7) The site shall establish and maintain an access road around the waste boundary for access by emergency or fire-fighting vehicles and equipment. 15A NCAC 13B .0566 (7) - Access roads shall be of all-weather construction and shall be maintained to allow access by vehicles transporting waste, Department staff, and fire-fighting vehicles. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 5 of 6 3. Cover seemed good and slopes were 3:1 ratio. Good job. Side slopes need mowing to the toe of slope. Overgrown vegetation should be mowed. Site is well maintained, but more frequent mowing is needed. Be sure and keep trees and large shrubs from growing on top and sides of the LCID in the future. 4. Edge of Waste (EOW) markers were visible, but mowing will allow them to be seen more. They should be visible from one to the other. Perimeter road and side slopes need mowing. EOW marker hardly visible. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 6 of 6 5. LCID has an Inert Debris Storage, Treatment and Processing unit with permit renewal. Sorting of soil from concrete and asphalt is being done on future phases of LCID. Be mindful of the limits of waste storage at this area. Permit Attachment 3, Part VII, (8) c. On an average daily basis, approximately 40 tons of CAB will be stored at the unit. T and P area, road cones control traffic and mark EOW.
