The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. David Powell with the Solid Waste Section (Section) returned to the NLCID and met Mr. Pegram onsite, and
both walked the limits of the landfill. Mr. Powell needed to follow up and Mr. Pegram asked for some technical assistance on the corrective actions for final closure and requested additional time. 2. Mr. Pegram provided copies of weight tickets, Mr. Powell took photos, for disposal of previous unapproved wastes onsite. It was disposed of at Cumberland County Landfill.

3. This NLCID is mostly covered, grassed and somewhat sloped. Waste has been compacted and covered that was not during last visit. Unapproved wastes have been removed. Edge of Waste (EOW) markers are installed around the notification marking disposal. More are needed for them to be visible from one to another.
4. It was discussed onsite about the lay of the land may encourage stormwater to run downhill and toward part of the disposal of the NLICD. Be careful not to put waste in water and creating leachate. Mr. Pegram should cover and slope NLCID and surrounding land to alleviate this situation. Mr. Pegram had altered his entrance road to minimize this issue, but more work is needed. Older and covered part of NLCID needs soil added and better sloping to meet one foot of compacted soil cover.

5. Mr. Pegram has marked edge of waste disposal but is too close to adjacent property, and therefore, waste is inside the 100-foot buffer. However, Mr. Pegram owns that adjacent parcel, and can either move the waste to meet the buffer or move the property line to meet the buffer. If he chooses to move the waste then it must meet the buffer, be covered, compacted and sloped 3:1. Any new deed or maps created should mark the limits, size and placement of the NLCID and be recorded with County Register of Deeds, along with copies sent via email to david.powell@ncdenr.gov or by mail.
6. Mr. Pegram has decided to go ahead and officially close the NLCID. The NLCID basically was closed prior to 2021 new LCID rules, it just needs some corrective actions and documentation to properly be closed in the Sections records and meet previous rule requirements for closure. 7. The NLCID waste must be inside the two-acre notification, meet buffers, be compacted, covered with at least 12 inches of soil, and sloped 3:1. A follow up will be needed to ensure buffers are met and waste is inside the EOW for the two-acre approved disposal area. Please mark the Edge of Waste (EOW), and property line to measure size of the waste disposal and to measure buffers. To finalize closure, a cap survey is required to be completed, by a land surveyor, certifying that at least one foot of suitable soil cover has been placed over the entire landfill, utilizing 4 random test holes per acre. This survey should be recorded with the County Register of Deeds as well. Once completed, a copy of the cap survey, with land surveyors name, signature and company name should be submitted to the Section, David Powell, along with a letter to the Section stating that the owners, “Request closure and have completed the corrective actions in recent inspections.” In addition, this letter should include the name of the facility, notification number, owners name, return mailing address and contact information and be signed by the landowner. These can be sent via email to david.powell@ncdenr.gov or by mail.

8. Corrective measures are necessary as a result of this inspection and should be completed within 60 days’ receipt of this report. Mr. Powell will attempt to return around that timeframe and evaluate the progress of the corrective actions. Failure to meet the conditions for compliance may result in further Compliance Actions.
