PURPOSE OF SITE VISIT:
Partial Facility Compliance Inspection without records review
STATUS OF PAST NOTED VIOLATIONS:
1) 15A NCAC 13B .1627 (d)(1)(A) states “Following closure of each MSWLF unit, the owner or operator shall
conduct post-closure care. Post-closure care shall …consist of the following: maintaining the integrity and
effectiveness of any cap system, including making repairs to the cover as necessary to correct the effects of
settlement, subsidence, erosion, or other events, and preventing rainwater that drains over land from or onto
any part of the facility or unit from eroding or damaging the cap system;” Unresolved
OBSERVED VIOLATIONS:

Please see the ADDITIONAL COMMENTS section below for details concerning the violation(s) listed above.
ADDITIONAL COMMENTS:
1) This Facility is a closed MSW Landfill and a closed Asbestos Waste Disposal Site.
2) The site is secured by a locked gate at the Facility entrance.
3) Proper signage is posted at the entry gate stating the permit number and Facility contact information.
4) The Facility access road is of all-weather construction and appears well maintained at this time.
5) This Facility manages Landfill Gas (LFG) through a collection system which is plumbed to the adjacent
active Onslow County MSW Landfill, permit #67-09 for use at the onsite Onslow Power Producers/Cube
District Energy llc LFG-to-energy plant.
6) The Landfill Gas collection system appears well maintained at this time.
7) Facility monitoring wells were reviewed. All reviewed wells were readily accessible, properly labeled, and
secured with functioning locks.
8) The closed Asbestos Disposal Area was reviewed.
9) The closed Asbestos Disposal Area is clearly marked and has a well-established cover crop of native warm
season grasses which is mowed throughout the growing season as necessary. This area appears well
maintained at this time.
10) Permanent, highly visible Edge-of-Waste (EOW) markers delineating the waste disposal boundary and are
being maintained as required.
11) Overall, this Facility has a well-maintained cover crop of native warm season grasses. The landfill cover crop
has recently been mowed.
12) Areas of sparse cover with erosion of the landfill cap system were observed throughout the landfill. Some of
these areas have recently been filled and graded, however, continued corrective measures are required.
*Within thirty days of receipt of this Facility Compliance Inspection Report (FCIR), plans need to be
underway for the repair of these areas. All eroded areas should be filled with suitable soil and graded at a
slope not greater than 3:1. All repaired areas and any areas with sparse cover should be seeded and mulched
to establish a groundcover suitable to prevent erosion of your landfill cap system.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

13) Some of the recently filled areas have been rutted by maintenance equipment traffic. *Please advise all
equipment operators to keep heavy equipment clear of all repaired areas until the cap repair is completed and
a cover crop is established.
14) Areas of seeping leachate were observed in several of the eroded areas and in various places on both the
southern and northern outside slopes of the landfill. No leachate was observed leaving the permitted disposal
footprint of the landfill. *Withing thirty days of receipt of this FCIR, please repair the landfill cap system in
all seeping areas. The repaired areas should be graded at a slope not greater than 3:1, seeded, and mulched to
establish a groundcover suitable to prevent erosion of your landfill cap system. Please monitor all repaired
areas for continued seeping. Any areas where leachate continues to seep should be addressed promptly to
prevent the release of leachate outside the permitted disposal boundary.
15) Areas of differential settlement were observed in various areas on the southern outside slope of the landfill.
*In order to promote the positive flow of surface waters from the landfill, plans should be underway for the

filling and grading of all differentially settled areas throughout the landfill. These areas should be filled with
suitable soil and graded at a slope not greater than 3:1. All repaired areas should be seeded and mulched to
establish a groundcover suitable to prevent erosion of your landfill cap system.
16) Woody brush and small trees were observed growing in an around the rip rap berm on the top lift of the
landfill. **Within thirty days of receipt of this Facility Compliance Inspection Report (FCIR), plans need to
be underway for the removal of all trees and woody vegetation from the landfill.
17) The erosion observed around the surface water control structure and downpipe leading from the southwestern
sideslope during the previous Facility Compliance Inspection has been repaired and all the woody vegetation
observed growing in this area has been removed.
18) *Continued corrective measures are required as a result of this Facility Compliance Inspection.
