SUBJECT: Notice of Deficiency Compliance Inspection Report

Dear Mr. Greg Martin,
On 8/17/2022, David Powell, representing the State of North Carolina, Division of Waste Management Solid
Waste Section (Section), reviewed the Facility Annual Report, submitted to the Section for the above referenced
facility, as required to comply with the North Carolina solid waste statutes and rules. The following violation was
noted:
A. 15A NCAC 13B .0405 (7) - Training. During hours of operation, an operator trained in accordance
with G.S. 130A-309.25 shall be on-site. Sites shall provide all staff with no less than eight hours of
training updates annually that includes a review of the operations plan and permit documents.
Documentation of the training shall be placed in the operating record and provided to the Division
upon written request.
Upon review of the Facility Annual Report submitted to the Section by Bladen County Transfer
Station, it was documented that the Station’s operators’ certifications had been expired since
December of 2021. Further investigation with Station staff via email, confirmed the Station was
operating with no operators with current certifications and was waiting until December 2022 to
recertify. However, one staff member is registered for a certification course on 8/24/2022 and
documentation of the registration was submitted to David Powell.
The above violations may have or can compromise the facility’s ability to ensure protection of the public health
and the environment and thus require remedial action on behalf of the facility in order to maintain compliance
with 15A NCAC 13B .0405 (7). Based upon the foregoing, Mr. Greg Martin/Bladen County Transfer Station shall
come into compliance by September 19, 2022, with all requirements of the regulations in 15A NCAC 13B .0405
(7) by completing the following at the Bladen County Transfer Station:
Bladen County Transfer Station shall provide documentation confirming the station has an operator trained in
accordance with G.S. 130A-309.25, onsite during operating hours of the Transfer Station at all times if it is
operating. This documentation shall Include any actions taken to prevent these violations from occurring in the
future. Email this documentation to David Powell, at david.powell@ncdenr.gov, before the noted compliance
date.

The violation(s) listed above were noted by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to
this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day
may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may
also be subject to enforcement actions including penalties, injunction from operation of a solid waste
management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
Please keep me informed of your progress in this matter. Solid Waste Section staff will follow up to verify that the operator has completed the requirements of this Notice of Deficiency.
