Septage Management Firms are required to obtain a permit to operate in NC as per NC General Statutes and the Solid Waste Management Rules. Specifically, NCGS 130A-291.1(c) requires that a Septage Management Firm obtain a permit from the Department prior to operating. In addition, NC Septage Management Rule 15A NCAC 13B .0832(b)(3) requires a Septage Management Firm Permit for the placement of a chemical or portable toilet for potential use. The requirement for firms managing septage to be permitted has been in effect since 1994. North Carolina General Statute (NCGS) 130A-291.1(c) requires firms that commence operation without first obtaining a permit pay an initial fee equal to twice the amount that would otherwise be applicable. The annual permit fee requirement is $550 if one vehicle is operated or for placement of portable toilets and $800 if more than one vehicle is operated as per GS 130A-291.1(e). Based on GS 130A-291.1(c), the required permit fee is $1,100.00 based on GS 130A-291.1(c). Payment of the total cost of $1,100.00 should be made by money order or certified check payable to Division of Waste Management. The payment should be mailed to attention of: Division of Waste Management, Solid Waste Section Atten: Mr. Chester Cobb 1646 Mail Service Center Raleigh, NC 27699-1646 Continued operation in NC without a permit may result in a compliance order with administrative penalty.
