OBSERVED VIOLATIONS:
A. 15A NCAC 13B .0203(d) states: `By receiving solid waste at a permitted facility, the permittee(s) shall be
considered to have accepted the conditions of the permit and shall comply with the conditions of the permit."
Permit to Operate 4507-TP-, Attachment 3, Part VI: Transfer Station/Treatment & Processing Unit(s), #10 states,
"All wood and processed materials must be maintained at least 50 feet from the property boundary lines and from
the onsite surface water stream."
Riverside Stump Dump at Mills River is in violation of 15A NCAC 13B .0203(d) in that mulch was observed
being stored within 50 feet of the onsite surface water stream.
To correct the violation, Riverside Stump Dump at Mills River must remove all material that is stored
within 50 feet of the onsite surface water stream within 15 days of the date of the report.

Mulch Stored Within 50 feet of the Onsite Stream
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
1. All photos were taken by Lee Hill on August 11, 2022.
2. The facility is approved to receive stumps, land clearing debris, untreated and unpainted dimensional lumber
and pallets. Yard trash is not acceptable at the site.
3. The operating hours for the facility are Monday through Friday, 7:OOAM to 5:30PM, with seasonal hours on
Saturdays, depending on demand.
4. Gates are installed at the entrance and exit of the facility to prevent unauthorized entry. Signage was posted at the
entrance with the permit number and emergency contact information.
5. The permit and operations plan were available upon request.
6. Tonnage Records were reviewed from the FY2021-2022 Facility Annual Report. The facility received
18,132.00 tons of material from July 1, 2021 to June 30, 2022.

7. The facility was grinding land clearing debris at the time of inspection.
8. Interior roadways were of all-weather construction and were being maintained at the time of inspection.
9. Waste and finished product were stored in reasonably sized piles with adequate fire breaks and lanes between
them to allow for vehicular access in case of an emergency.

10. Finished product was observed being stored approximately 15 feet from the onsite stream on the southeast side
of the facility. Remove all material that is being stored within the 50 feet of the onsite stream. See
Observed Violation section of this report.
11. Permanent boundary markers delineating the 50-foot setback to the property line were installed along the north
and west sides of the facility. Stream buffers markers are installed on the northern side of the lower access road,
but no markers are installed to the south side of the access road. It is recommended that buffer markers be
installed on the southeast side of the stream to prevent future encroachment of the stream buffer.
12. Three painted pallets were observed in what appeared to be a recently dumped load in the pallet stockpile. No
unapproved waste was observed in the land clearing stockpile. Remove all unapproved wastes from the
stockpiles and place them in the onsite dumpster as they are encountered.
