(Operator) on June 8, 2020, and will expire on January 10, 2061. PURPOSE OF SITE VISIT: Partial Compliance Inspection STATUS OF PAST NOTED VIOLATIONS: None OBSERVED VIOLATIONS: A. Permit to Operate, Attachment 3, Part III, (25) “Unless alternative materials or an alternative thickness of cover has been approved by the Section, waste must be covered with six inches of earthen materials when the waste disposal area exceeds one-half acre and at least once weekly. Cover must be placed at more frequent intervals if necessary to control disease vectors, fires, odors, blowing litter, and scavenging. A notation of the date and time of the cover must be recorded in the operating record.” FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 7 At the time of this inspection, the active working face exceeded ½ acre in size. Mr. Tharp stated the working face would immediately be reduced to ½ acre or less by the end of the working day. Ensure that the active working face does not exceed ½ acre in size. On Thursday 7/28/2022 Mr. Tharp sent pictures to Section staff displaying reduction of the working face to required ½ acre dimensions. See attached pictures on Page 6. B. Permit to Operate, Attachment 3, Part III, (22)(a) “A responsible individual certified in landfill operations must be on-site during all operating hours of the facility at all times while open for public use to ensure compliance with operational requirements.” Upon arrival of Section staff at the facility, no responsible individual certified in landfill operations was present on-site. The facility employee stationed in the scale house contacted the landfill manager, Cooper Tharp, who then arrived onsite within the following 10 minutes. Ensure certified staff is present during all operating hours in accordance with the Permit to Operate and 15A NCAC 13B .0542 (j)(2). ADDITIONAL COMMENTS Shotwell Landfill is a construction and demolition landfill, C&DLF, located at 4724 Smithfield Road, Wendell, Wake County, North Carolina. The facility has received a permit to construct Phase 6 of the landfill and has completed land clearing activities for this project. The facility has also received a permit to construct a Mixed Waste Processing facility and began construction in April 2022. 1. During this inspection, it was noted that a large pile of comingled wood waste awaiting processing by grinders and/or chippers was being stockpiled to the northeast of the working face. This pile contained mixed waste material in addition to clean wood materials. Ensure all non-wood waste material is removed and properly disposed of prior to grinding. 2. Concrete and inert debris were being stockpiled adjacent to the clean wood and C&D waste processing area that is not approved. The inert debris processing area is shown collocated with the land clearing debris processing area. These areas may be relocated as needed within the landfill property boundary as operations plans dictate. 3. During this inspection, a large amount of exposed waste was observed on the western side slope. Areas that will not have additional wastes placed on them for three months or more, but where final termination of disposal operations has not occurred, shall be covered and stabilized with vegetative ground cover or other stabilizing material. Additional cover soil will need to be applied over areas of exposed waste prior to seeding and stabilization of these areas. 4. Permit to Operate, Attachment 3, Part VII, (62) Areas must be operated and maintained with sufficient dust control measures to minimize airborne emissions and to prevent dust from becoming a nuisance or safety hazard. During this inspection, large amounts of dust were present throughout the working face and adjacent areas. A water truck was not in use or located at the site during this inspection. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 3 of 7 Mr. Tharp stated that their water truck was out of service with a flat tire. It is recommended that a water truck be utilized to reduce dust emissions from the landfill. 5. As identified in the previous inspection, an area located on the southwestern slope below the working face and adjacent to the sediment basin has a slope greater than 3:1 and is highly eroded. Numerous erosion rills had formed in this area, along with a large gulley in which exposed waste was observed. The silt fencing in this area had partially failed due to the high amount of sediment and velocity of surface water runoff. It is recommended that this area is filled with soil, graded, and stabilized to reduce the velocity of surface water runoff. 6. The sediment basin located to the southwest of the working face contained excess sediment, woody debris, and C&D waste within the basin. Woody debris had collected on top of the riser pipe outlet and C&D waste had washed out of the backside of the basin and accumulated on the bank. Ensure this sediment basin is cleaned out, returned to plan dimensions, and properly maintained. Additional sampling may be required due to waste washing outside of the edge of waste and into and along the perimeter of the sediment basin to ensure there are no offsite impacts. 7. During this inspection, a leachate seep was observed on the southern slope of the landfill within the edge of waste. Ensure any leachate seeps are repaired in a timely manner and monitored as needed. 8. The following are certified facility personnel: a) Cooper Tharp, Certified Landfill Operations Specialist, LF-2022007, exp. 3/8/2025 Recommend facility operations staff receive training as necessary to maintain facility coverage during operating hours as required by the permit and rule. 9. Records were not reviewed during this inspection. 10. Approved modified operations plan part 11. D. d. states that “At least one responsible individual trained in the provisions of the National Emission Standards for Hazardous Air Pollutants (NESHAP) as an Asbestos Abatement Contractor/Supervisor will be present at all times during all operating hours of the facility. Site employees will receive annual training on asbestos awareness and the identification of ACMS”. Ensure that properly trained staff are present at the facility at all times while operating. 11. On Thursday 7/28/2022 Mr. Tharp sent pictures to Section staff displaying reduction of the working face to required ½ acre dimensions. See attached pictures. 12. Effective May 2, 2022, Wake County approved amendments to the facility’s franchise agreement as follows: a. Increase the tonnage threshold from 91,250 tons per year for disposal up to 365,000 tons per year (disposal and recycling). b. Increase the franchise service area to include six additional counties: Durham, Granville, Franklin, Nash, Harnett and Chatham. c. Construct and operate a construction and demolition waste material recovery facility (MRF) for the purpose of recycling construction and demolition waste. 13. The permit to construct the MRF (9226-MWP-2020) was previously issued by the Section in November 2020. Construction activities began in April 2022. 14. The franchise changes of a greater than 10% increase in the quantity of solid waste to be disposed of in the landfill and changes to the geographic area to be served by the landfill require amendment of the Section issued Solid Waste permit. An application to amend the permit has been submitted to the Section and is currently under review. 15. Until the permit under review is approved, the landfill is required to continue to operate within the currently approved permit conditions. As such, the facility may only accept 91,250 tons per year. 16.
