I was able to follow-up on researching the requirements put forth under LUR 2 of the Notice concerning the sampling of groundwater for Hexavalent Chromium under the approved Natural Attenuation Corrective Action Plan, along with a review of the 2017 CAP 5 Year Monitoring Report provided as an attachment to your previous email, it is evident that the groundwater concentrations for said constituent is below the predicted modeling shown in Figure 18 of the CAP. Therefore, according to the stipulations of LUR 2, no additional sampling is needed for the uses specified in LUR 1 of the Notice and thus have fulfilled requirements of LUR 2 in making the property safe for the specified uses. Please continue with having each owner complete the attached updated LURU form and return by email. The new version has replaced the old online form containing errors. The same method of downloading the form will retrieve the updated version as well. Our records show that the last LUR Update received by an owner was in 2016 (CLT Group). Therefore, please have each owner provide remarks under LUR 9 (and/or other applicable LURs) as to each of the current owners past compliance with the Notice/Agreement for those years we did not receive an annual update. Alternatively, each owner can provide a separate LURU for each year they previously missed. I believe by doing so, it will show compliance with the LURs throughout the ownership of the property up until this present time. Once we have received the current LURU form(s), the owners will have complied with the reporting requirements under LUR 9, barring any other LUR non-compliance. Additionally, please ensure that all documents (deeds, etc…) transferring interest in the property contain the language specified in paragraph 20 of the Agreement (exhibit A to the Notice of Brownfields Property). To aid owners with complying with future LURU submissions in January, they can join our LURU reminder email list using the link below my signature. They will then receive an email on January 2 of each year containing pertinent information regarding those annual submittals. If I can be of further help, please let me know.
