Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. The facility if permitted as a Small Type 1 Yard Waste facility. Such facilities are restricted to an area of less than two (2) acres and may receive only yard and garden waste, silvicultural waste, untreated and unpainted wood waste or any combination thereof. 2. 15A NCAC 13B .1402 (e)(6)(A) states: "Small Type 1 facilities shall have an operations area less than two acres in size and shall be limited to no more than 6,000 cubic yards material onsite at any given time, includingfinished product ". 3. A gate was located at the entrance to the facility to prevent unauthorized access. 4. The access road was of all-weather construction and well maintained. 5. No unacceptable waste streams were observed. A roll out is located on the property to deposit the occasional unacceptable waste. 6. The facility is not open to the general public for disposal of yard trash and is only used by the Town of Mooresville and Iredell County. 7. Grass clippings are transported weekly to the Iredell County Mulching and Grinding area at the MSW Landfill Facility. 8. Limb debris is dumped from the town. Once a year Farmer's Mulch from Dobson brings equipment to grind the debris and he loads and hauls off what he grinds for him to market. The debris accumulates until there is enough to bring in Farmer's Mulch. 9. Farmer's Mulch is currently on -site grinding the yard waste. 10. No ponding was observed around the yard waste pile. 11. No objectionable odors were observed onsite. 12. The site is in compliance with all buffer requirements. 13. This facility does not compost so no temperature records are kept. 14. The working area of the site is less than 2 acres.
