Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. David Powell inspected the Merritt Brothers NLCIDLF for a follow up on corrective actions and to ensure site conditions met rules for closure. Upon arrival, Mr. Powell met with onsite representatives Riley Merritt and Nathan Riley and discussed Merritt Brothers intentions with NLCID. They indicated Mr. Perry Merritt wished to close the NLCID and had finished the corrective actions as requested and added additional soil cover to meet closure rules. “No Dumping” signs and an additional locked gate have been added to prevent NLCID from being used further. 2. Site is secured by fence and gate, and roads were of all-weather construction. Road access was previously only to the front and one side of the LF. Access is now available around the landfill for firefighting and inspecting. Good job. 3. Site has received additional soil cover, been compacted, and sloped to 3:1 or less. Trees have been removed, as requested, and concrete behind NLCID has been put into NLCID and covered appropriately as well. Onsite representatives indicated they wanted to wait until final inspection confirmed all issues were addressed before they seeded vegetation across the NLCID. Good job. Edge of Waste (EOW) markers showing the limits of waste have been installed around the perimeter. Buffers are met and the NLCID is smaller than 2 acres in size. Erosion control fence surrounds most of the NLICD, outside of the access road. Good cover, slope, and erosion control fence around NCLID and access road. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 4 of 5 5. Mr. Powell probed soil to randomly check cover while onsite with onsite representatives. However, to finalize closure, a cap survey is required to be completed, by a land surveyor, certifying that at least one foot of suitable soil cover has been placed over the entire landfill, utilizing 4 random test holes per acre. This survey should be recorded with the County Register of Deeds as well. Once completed, a copy of the cap survey, with land surveyors name, signature and company name should be submitted to the Section, David Powell, along with a letter to the Section stating that the owners, “Request closure and have completed closure according to Rule 15A NCAC 13B .0567 and will conduct Post Closure Care according to also according to Rule 15A NCAC 13B .0567 for ten years following closure.” In addition, this letter should include the name of the facility, notification number, owners name, return mailing address and contact information and be signed by the landowner. These can be sent via email to david.powell@ncdenr.gov or by mail. Testing soil cover on top NLCID. 6. Closure and Post Closure Care rules, 15A NCAC 13B .0567, were discussed while onsite, rules previously sent to owner’s email. NLCID should be maintained with one foot of cover, vegetation enough to restrain erosion but not allow trees or large shrubs to grow onsite. This will hinder the ability to check for erosion and proper cover. Slope shall remain 3:1, EOW markers shall be maintained to show limits of waste disposal. The NLCID, N0409, can no longer accept any waste without a permit from the Section. 7. Vegetation needs establishing on the closed NLCID. Mr. Powell can revisit and take a photo and confirm vegetation has been established or Ms. Donna can email a couple photos once vegetation has started growing on the NLCID, via email. 8. Once the required letter, cap survey, and proof of registering with County Register of Deeds is provided, a letter will be submitted to landowner confirming closure of the NLCID with the NC DEQ Division of Waste Management - Solid Waste Section for your records. Please submit these documents as soon as possible but with 30 days receipt of this inspection report. If you should have any difficulty, please contact David Powell.
