The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. The facility if permitted as a Small Type 1 Yard Waste facility. Such facilities are restricted to an area of less than
two (2) acres and may receive only yard and garden waste, silvicultural waste, untreated and unpainted wood waste
or any combination thereof.
2. 15A NCAC 13B .1402 (e)(6)(A) states: "Small Type 1 facilities shall have an operations area less than two acres
in size and shall be limited to no more than 6, 000 cubic yards material onsite at any given time, including finished
product ".
3. Proper signage was posted at the entrance to the facility.
4. The cable at the entrance was damaged and is scheduled to be repaired by the end of the week to prevent
unauthorized access.
5. The access road was of all-weather construction and well maintained.
6. The facility is not open to the public for disposal of yard trash and is only used by the City of Gastonia.
7. Yard waste material is staged and processed on a concrete pad.
8. No unacceptable waste streams were observed. Spoke with Mr. Hendrickson about putting a roll out on the
property to deposit the occasional unacceptable waste. Currently the site is inspected 2-3 times a week for
unacceptable waste.
9. Material is ground once a year and utilized by city departments for beautification.
10. No ponding was observed on -site.
11. No objectionable odors were observed on -site.
12. The site is in compliance with all buffer requirements.
13. The working area of the site is less than 2 acres.
