Box 910 Pittsboro, NC 27312 PARTICIPANTS: Chuck Kirchner, Environmental Senior Specialist, Solid Waste Section Robert Pike, Environmental Senior Specialist, Solid Waste Section Sonya Gilliland, Operations Manager – Solid Waste & Recycling Division, Chatham County Public Works Department Kevin Lindley, Director – Chatham County Public Works Department STATUS OF PERMIT: Closed PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: None OBSERVED VIOLATIONS: A. 15A North Carolina Administrative Code 02C .0108(l) states: “All non-water supply wells, including temporary wells, shall be secured with a locking well cap to ensure against unauthorized access and use.” During the inspection, well MP-10 was observed unprotected against unauthorized access and use. Therefore, Chatham County is in violation of 15A NCAC 02C .0108(l). FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 4 To achieve compliance, Chatham County must secure MP-10 landfill gas well with a locking well cap that shall ensure against unauthorized access and use. B. 15A North Carolina Administrative Code 02C .0108(m) states: “All non-water supply wells shall be equipped with a steel outer well casing or flush-mount cover, set in concrete, and other measures sufficient to protect the well from damage by normal site activities.” During the inspection, the top sections of well MP-10 was observed without an outer steel casing. Therefore, the Chatham County is in violation of 15A NCAC 02C .0108(m). To achieve compliance, the Chatham County shall secure MP-10 landfill gas well with an outer steel casing. C. 15A North Carolina Administrative Code 02C .0108(p) states: “Each non-water supply well shall have permanently affixed an identification plate. The identification plate shall be constructed of a durable, waterproof, rustproof metal or other material approved by the Department as equivalent and shall contain the following information: (1) well contractor name and certification number (2) date well completed (3) total depth of well (4) a warning that the well is not for water supply and that the groundwater may contain hazardous materials (5) depth(s) to the top(s) and bottom(s) of the screen(s); and (6) the well identification number or name assigned by the well owner.” During the inspection, well MP-10 was observed without an affixed identification plate. Therefore, Chatham County is in violation of 15A NCAC 02C .0108(p). To achieve compliance, Chatham County shall ensure MP-10 landfill gas well has an affixed identification plate. This plate shall include: (1) well contractor name and certification number; (2) date well completed; (3) total depth of well; (4) a warning that the well is not for water supply and that any groundwater may contain hazardous materials; (5) depth(s) to the top(s) and bottom(s) of the screen(s); and (6) the well identification number or name assigned by the well owner. ADDITIONAL COMMENTS On July 29, 2022, Chuck Kirchner and Robert Pike met with Sonya Gilliland and Kevin Lindley to conduct a comprehensive post closure inspection of the Chatham County Closed MSW Landfill on County Services Road in Pittsboro, Chatham County. Facility Information: 1. The facility is a closed municipal solid waste landfill (MSW) owned by Chatham County. 2. The facility ceased operations on or before October 9, 1993. 3. The closed MSW landfill is ~80 acres. 4. The Solid Waste & Recycling Division office is open Monday through Friday 7:00 am to 4:00 pm. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. The facility is located on property containing the Solid Waste & Recycling Division office, the Chatham County Permanent Household Hazardous Waste Collection Facility (19-04 HHW), and the notified land clearing and inert debris (LCID) landfill (N0069). The property also includes an additional TDDSS located within the LCID landfill footprint (DS19-002). Records Review: 6. The facility maintains semiannual groundwater and surface water monitoring records. Monitoring is conducted by Smith Gardner, Inc. Prism Laboratories, Inc. in Charlotte, NC (NC Certification #402) conducted the analysis. Records were verified for May 30, 2019, November 18, 2019, May 4, 2021 and November 1, 2021. Exceedances were reported for these monitoring events. 7. The facility uses five groundwater monitoring wells: MW-1, MW-2, MW-3, MW-4, MW-5 and two surface water locations: SW-1 and SW-2. 8. The facility maintains quarterly methane monitoring records. Monitoring is conducted by Smith Gardner, Inc. Records were verified for all four quarters for 2019, 2020 and 2021 and for February 15, 2022 and June, 2022. Exceedances were noted in two monitoring events. The facility notified the Section of these exceedances. No exceedances were observed in 2022 monitoring events. 9. The facility uses fourteen landfill gas monitoring wells: MP-1, MP-2, MP-3, MP-4, MP-5, MP-6, MP-7, MP-8, MP-10, MP-11, MP-12, MP-15, MP-18 and MP-19. 10. A GEM5000 Gas Monitor, S/N G506472, was used to sample the landfill gas wells. This monitor was last calibrated in December of 2021. 11. The facility maintains records of the scrap tires received. All scrap tire records were made available for review. Scrap tire records from April 2019 through June 2022 were observed and appear to be documented properly. It appears about 5 trailers a month are hauled to Central Carolina Holdings, LLC. Site Inspection: 12. During this inspection landfill gas monitoring well MP-10 was inspected. All the environmental monitoring wells will be inspected in a follow-up inspection. Ms. Gilliland stated that most of the landfill gas wells were similar to MP-10. Ensure that all wells meet the requirements of 15A NCAC 02C. Please see Observed Violations section of this report. 13. Ongoing solid waste management activities associated with the closed MSW landfill post closure conditions dated December 12, 1996 are as follows: scrap tire collection, recyclables collection area, and the yard waste compost operation. Adjacent to the scale house on a gravel pad are two trailers for scrap tire collection and transportation, a container behind the tire trailers is used to collect empty, triple rinsed, pesticide containers. In addition, there are three more closed containers designated to collect Styrofoam, glass and mix recycling and an open container for scrap metal/white goods and an open container for electronic waste. The gravel area is free from any waste material and is maintained in good condition. 14. The yard waste compost operation is located south of the scale house. Currently there is 2,200 tons of yard waste scheduled to be ground on site. The yard waste is currently in the process of being ground. 15. The Chatham County Sheriff’s Office operates a shooting range adjacent to the landfill on the property. 16. Edge of Waste (EOW) is delineated by orange PVC pipes installed at the waste boundary. Ensure EOW markers are repaired as needed. 17. The landfill cap is well covered with native grasses. Good grass cover was noted in all areas and there was no indication of erosion, rills or runoff. 18. Chatham County has constructed a recycling station with a fabric covered arch building to house the recyclables. Ensure any windblown litter in this area is picked up. 19. The area allotted for the LCID landfill (N0069) is also a Temporary Debris Storage and Reduction Site (TDSR – DS19-002). The LCID landfill site may be used as an alternative TDSR to collect and store disaster debris until it can be processed. 20. The area allotted for the yard waste compost operation is also a Temporary Debris Storage and Reduction Site (TDSR – DS19-003). The yard waste compost operation site should be operated in a way that as much area as possible is maintained to collect and store disaster debris until it can be processed. A second six-acre TDSR site (DS19-004) is located on the property directly east of the above-mentioned yard waste compost/DS19-003 area. Approximately two of the six acres has been cleared for use. Chatham County shall maintain a 100’ buffer to property lines and a 50’ buffer to streams/wetlands if additional trees are cleared in this area. General Comments: 22. The Pittsboro Fire Department can be contacted to respond to an emergency at the facility. 23. Access roads are of all-weather construction. 24. The closed MSW landfill is secured by a locked gate at the property entrance. 25. Proper signage is located on the property.
