ADDITIONAL COMMENTS
On July 29, 2022, Chuck Kirchner and Robert Pike met with Sonya Gilliland to conduct a comprehensive inspection of the Chatham County LCID Landfill on County Services Road in Pittsboro, Chatham County. 1. The facility is a land clearing and inert debris (LCID) landfill. 2. This inspection was to ensure the LCID Landfill is in compliance with 15A North Carolina Administrative Code (NCAC) 13B .0563, .0564 .0566 and .0567. 3. The facility is open Monday through Friday 7:00 am to 4:00 pm. 4. The LCID landfill is approximately 1/8 acre in size. 5. The LCID landfill only accepts inert debris. Land clearing debris (LCD) is currently diverted to the yard waste compost operation located on the property.
6. Per 15A NCAC 13B .0566 (3), “All waste shall be covered with no less than six inches of soil monthly, or when the working face reaches one acre in size, whichever occurs first. Any soils used for cover at the site shall meet unrestricted use standards for soils as defined in G.S. 130A-310.65.”
7. Closure and post closure care requirements for LCID landfills may be found in 15A NCAC 13B .0567. 8. Please contact Jordan Russ, Permitting Branch Engineer, to discuss alternative uses for this area if desired. A LCID permit may not be required for a beneficial fill area.
9. Inert material is covered with soil. 10. Brick and concrete along the east side of the access road that was noted on the previous inspection report has been cleaned up and the site appeared in good condition. 11. Side slopes should be graded such that a 3H:1V slope ratio is obtained upon completion. 12. Beneficial fill could be placed in this area without the requirement of an LCID permit. 13. Ensure the landfill area is continually graded accordingly. 14. Soil is stockpiled on the right side of the LCID landfill. Soil available on site for cover is vary adequate. 15. Access roads are of all-weather construction. 16. The LCID landfill is secured by a locked gate at the property entrance. 17. Proper signage is located on the property. 18. The LCID landfill is also a Temporary Disaster Storage and Reduction Site (TDSR, DS19-002). 19. If the landfill is used for the disposal of disaster debris operation must conform to the requirements of the LCID landfill. If the LCID landfill area is used as a TDSR it should not occur on the landfill cap. It is suggested that the remaining landfill area (less than 2 acres) is cleared of vegetation and an access road installed.
20. The facility is located on property containing the Solid Waste & Recycling Division office and the closed municipal solid waste (MSW) landfill (19-01) and associated yard waste compost operation and convenience site. The property also includes two additional TDSR’s: DS19-003 and DS19-004.
21. This site must close or obtain a permit by January 1, 2026. 15A NCAC 13B .0563(6) states “Within five years of the readopted effective date of this Rule, the owner or operator of a notified LCIDLF that was not closed prior to the readopted effective date of this Rule shall comply with the requirements of this Rule, or shall close the notified LCIDLF in accordance with Rule .0567(b) of this Section, except that the required notification of closure is not required to be certified. For the purpose of this Rule, "notified LCIDLF" means a site that was not required to obtain a permit from the Division prior to the readopted effective date of this Rule because the site was designed and constructed to be two acres or less in size, and was required to record a notification for the site with the Register of Deeds' office and submit the notification to the Division.” 15A

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
