The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
On July 27, 2022, Chuck Kirchner conducted a comprehensive inspection of the Westmoreland LCID Landfill on Lester Road in Stokesdale, Guilford County.
1. The Westmoreland land clearing and inert debris (LCID) landfill is located on Lester Road in Stokesdale. 2. Mr. Timothy Westmoreland stated that Mr. Norman Westmoreland passed away in February of this year. 3. Mr. Norman Westmoreland’s previous residence was located near the LCID landfill. This home has been sold and the current residents do not have any affiliation with the LCID landfill.
4. The property is currently deeded to Norman Westmoreland, L.L.C. and Mr. Timothy Westmoreland stated
that he and his sisters currently own the property. 5. Ms. Angela Westmoreland is listed with the Secretary of State as the Registered Agent and Manager of Norman Westmoreland, L.L.C. Mr. Timothy C. Westmoreland and Ms. Steffni J. Stephens are both listed as Members as well.
6. Ms. Angela Westmoreland, Mr. Timothy C. Westmoreland and Ms. Steffni J. Stephens reside on Lester
Road near the LCID Landfill. 7. Mr. Timothy Westmoreland stated that the LCID landfill is no longer in operation. 8. 15A North Carolina Administrative Code (NCAC) 13B .0567 covers closure and post-closure care requirements for Land Clearing Inert Debris (LCID) landfills.
9. 15A NCAC 13B .0567 (b)(1) states in part: “The owner or operator of a site shall begin closure activities
no later than 30 days after the final receipt of wastes. Closure activities shall include the following: (A) covering the disposal area with no less than one foot of soil cover sloped to direct the flow of surface water from the landfill; (B) stabilizing the soil cover with vegetative ground cover or other stabilizing material.”
10. 15A NCAC 13B .0567 (b)(2) states: “The owner or operator of a site shall complete the closure activities within 120 days after beginning the closure activities.” 11. The LCID landfill is approximately 1.5 acres in size. 12. The LCID landfill was open to the general public. 13. The LCID landfill appeared to have adequate buffers between the waste boundary and waters of the state
and adjacent structures as required per 15A NCAC 13B .0564(9).
14. Ensure side slopes continue to maintain a 3:1 ratio and vegetative cover prevents erosion of landfill cap. 15. Open burning of solid waste is prohibited. 16. Mulch, stumps, tree debris and soil were observed on site. No unauthorized wastes observed on site during inspection.
17. No erosion of site was noted during inspection.
18. No surface water was observed impounded over waste. 19. Continue to ensure that water sheet flows off the LCID landfill. 20. The facility has an all-weather access road which is currently covered in vegetation. 21. This site must close or obtain a permit by January 1, 2026. 15A NCAC 13B .0563(6) states “Within
five years of the readopted effective date of this Rule, the owner or operator of a notified LCIDLF that
was not closed prior to the readopted effective date of this Rule shall comply with the requirements of this Rule, or shall close the notified LCIDLF in accordance with Rule .0567(b) of this Section, except that the required notification of closure is not required to be certified. For the purpose of this Rule, "notified LCIDLF" means a site that was not required to obtain a permit from the Division prior to the readopted
effective date of this Rule because the site was designed and constructed to be two acres or less in size,
and was required to record a notification for the site with the Register of Deeds' office and submit the notification to the Division.” 15A NCAC 13B .0563
