The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. David Powell with the Section met with Lucky Lady LCID representative Joel Williams and Land Surveyor
Shelton Raynor. Property is currently owned by Ampersand Field LLC. Registered agent for this LLC, is Mr. Williams Sister, Dawn Wallace.
2. Facility has ceased operations and now has had an engineer, Larry Upole Jr., certify final cover with submitting soil depth hole data with certification (submitted June 2021). Properties have been combined to ensure buffers
are met around the perimeter of the landfill and a new PLAT map submitted confirming those buffers. Edge of Waste (EOW) markers marking the 100 ft buffer have been installed and buffers confirmed by Land Surveyor Shelton Raynor. Site does have good vegetative cover and sloping. LCID currently needs mowing.
3. Section staff met onsite with Mr. Joel and Mr. Shelton to follow up and confirm the closure activities were completed at the landfill. Mr. Powell inspected the landfill while checking buffer distances with a laser range finder on all sides. Mr. Powell and onsite representatives drove around and on top of landfill. Soil cover and
sloping is good with good vegetative cover. Signage for no trespassing has been added and gates for limiting access now installed. True EOW markers, marking the limits of waste disposal, were not present around entire perimeter during inspection. These markers were installed by Mr. Joel Williams and Mr. Shelton Raynor after
Mr. Powell left the site and photos forward via email, later on July 29, 2022, to Mr. Powell by Ms. Dawn Wallace to confirm.

4. Communicate with Tim LaBounty, Engineering Supervisor with Division of Energy, Mineral, and Land Resources (DEMLR), on any requirements DEMLR may have with this site/closure. Contact info - tim.labounty@ncdenr.gov or 910-433-3300. Communicate with Moore County as well for any additional
closure requirements they may have.
5. Post Closure statement was submitted on July 13, 2022, via email. It stated that Ampersand Field LLC shall conduct post-closure care at Lucky Lady LCID permit 63-B and shall conform to the requirements of 15A NCAC 13B .0567 CLOSURE AND POST-CLOSURE CARE REQUIREMENTS FOR LCIDLFS. 6. REMINDER - 15A NCAC 13B .0567 (C)(3) - The buffer areas set forth in Rule .0564(6) of this Section or stated in the site permit shall not be developed or utilized for residential, commercial, industrial, or institutional purposes, including above-ground or below-ground construction or improvements such as utilities, roads, parking lots, and sidewalks. 7. Lucky Lady 63B is now considered CLOSED and can no longer accept waste. 8. Please be sure and maintain the site according to rule. Nothing should be stored or constructed upon the LICD. Site should be mowed to keep tress and large shrubs from growing, soil cover and slope maintained to restrain erosion and EOW markers maintained. The Section may periodically inspect the site and its
conditions to meet post closure rule.
