In accordance with North Carolina General Statute 130A-294 (a2) this permit is for life-of-site. Life-of-Site ends when the facility reaches its final permitted elevations or by June 24, 2057. PURPOSE OF SITE VISIT: Follow-up Compliance Inspection, Odor Complaint Investigation STATUS OF PAST NOTED VIOLATIONS: None STATUS OF PAST OBSERVED VIOLATIONS: A. 15A NCAC 13b .1626 (2)(b), “Except as provided in Sub-Item (c) of this Item, the owners or operators of all MSWLF units shall cover disposed solid waste with six inches of earthen material at the end of each operating day, or at more frequent intervals if necessary to prevent the escape of waste and the attraction of vectors and scavenging, and to minimize fires and the generation of odors.” PARTIALLY RESOLVED: During the inspection, exposed waste was observed on the northside slopes adjacent to the working face access road and on top of the landfill adjacent to the working face. Additional cover soil will need to be applied over areas of exposed waste prior to seeding and stabilization of these areas. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 4 ADDITIONAL COMMENTS Upper Piedmont Regional Landfill is, 7304-MSWLF-1997, is permitted to operate Phase 1 (Cells 1A, 2A, 3A, and 4A), Phase 2 (Cells 1B, 2B, 3B, and 4B), and Phase 3 (Cells 5A and 6A) of the municipal solid waste landfill. The facility is approved to accept an average maximum annual disposal rate of 780,000 tons per year. 1. Erosion rills on the northside non-vegetated slopes identified in previous inspection report were reduced in number and frequency. These areas still need to be repaired and properly vegetated. Mr. Harless stated that he is constantly working on getting grass to grow in these areas. Ms. Thompson recommended looking into local yard waste notification facilities in order to secure a mulch/compost supply to enhance vegetative growing conditions. 2. The erosion and sedimentation structure near Phase 5 remained inundated with sediment that had washed down the northern side slope. Mr. Harless stated that he will remove excess sediment from this area and install new silt fence. Also, the sediment basin located near the southeastern corner of the landfill continued to have excess sediment within the basin. Ensure erosion and sedimentation structures and devices are cleaned out and functioning properly and maintained. Basins should be cleaned out and returned to plan dimensions and properly maintained. 3. Windblown waste was actively being picked up during this inspection. Good job! 4. During this inspection, the water truck was in use and applying water to the access roads to suppress dust. Good job! 5. During this inspection, a leachate seep was observed on the northeastern slope of the landfill within the edge of waste. Ensure any leachate seeps are repaired in a timely manner and monitored as needed. 6. Permanent edge of waste (EOW) markers noted as missing in the previous inspection report were replaced on the southern side slope and were visible from one to the next. 7. During this inspection, one scrap tire was observed on the south side of the working face. Mr. Harless immediately radioed to his crew and instructed them to remove it. Facility staff must remove unacceptable wastes as soon as it is observed and dispose of properly. 8. In response to the odor complaint, no excessive odors were detected on top of the landfill or near the working face. Mr. Harless escorted Ms. Thompson and Mr. Davis on a drive around the public roads surrounding the landfill. No odors were detected during this drive. Mr. Harless stated that he makes this drive every morning to ensure no excessive odors are pervasive. 9. Digital photographs were taken during this inspection. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
