The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. The purpose of this visit was to follow up on the NLCID/IS782201 corrective actions and to finish inspection that was not completed on 6/23/2022.
2. Mr. Hammonds and Mr. Powell explained to Mr. Parker the issues with NLCID and IS782201 and corrective actions needed to resolve violations at each site.
3. Once all violations have been addressed, the NLCID will need to be operated and maintained according to rule.
Sloping and soil cover is an issue. Once the unapproved wastes are removed, slope is fixed to rule and enough to prevent erosion, then proper soil cover should be added and compacted. Then vegetation can be grown to maintain. However, site should be mowed enough to keep shrubs and trees from establishing. This will assist in confirming all exposed waste is covered as well. Therefore, a good slope is needed, so that soil cover will stay, sides can be maintained and maintenance on the structure.
4. All walked on top NLCID and viewed working face. The road did not appear to be of all-weather construction. Multiple unapproved and exposed wastes were visible on top and around sides. Unapproved wastes including large pieces of carpeting, clothing, different types of metal pipe and angled pieces, erosion control plastic
fencing, plastic corrugated pipe, and concrete with coatings were discovered spread out across working face and top the NLICD. Exposed waste is also in some areas along bottom slope of perimeter of NLCID. Cover with soil appropriately with 6 inches and restrain erosion. If closing NLICD additional soil cover is required. Refer to rules previously emailed. All NLCIDs must be permitted or closed, according to rule, by January 1, 2026.

5. Staff were unable to determine if property line buffers are being met on north and east sides due to lack of adequate edge of waste and property line markers. Previous attempts to have boundaries surveyed and marked
has not occurred. Replacement markers shall be installed to confirm rule required buffers.

6. Side slopes are too steep on north side, in many areas. So, find out property lines, then the buffer of 100 ft should be identified, then pull back anything that is outside of that area back inside the two-acre notification, if any. Cover properly with soil, compact and slope all sides 3:1. This should be enough to
restrain erosion from removing the soil cover.

7. The site must continue to cease all dumping operations until corrective actions have been completed and confirmed by representatives of the Section. Documentation of waste disposed other than the 2-acre notification should be emailed to Mr. Powell ASAP at david.powell@ncdenr.gov. A Notice of Continuing Violation will be sent for the NLCID.
8. Corrective measures are necessary as a result of this inspection and should be completed within 30 days receipt of this inspection. A follow up will be conducted around that time or shortly afterwards to confirm. If completed beforehand, communicate with Mr. Powell and he may can schedule a follow-up as soon as possible to confirm corrective actions complete. Enforcement actions for this site are underway.
