Parkton, NC 28371 PARTICIPANTS: Chris Parker, Parker and Sons David Powell, SWS Toni Miller, RCSW STATUS OF PERMIT: N1027 – Notification originally 2009 PURPOSE OF SITE VISIT: Comprehensive Inspection – Follow Up STATUS OF PAST NOTED VIOLATIONS: 15A NCAC 13B .0566 (1) - RESOLVED 15A NCAC 13B .0566 (2) - UNRESOLVED 15A NCAC 13B .0566 (3) – UNRESOLVED OBSERVED VIOLATIONS: NA The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. The purpose of this visit was to follow up on the NLCID/IS782201 corrective actions. David Powell met onsite with Toni Miller, Robeson County Solid Waste Enforcement Officer, at the Parker and Sons N1027 and illegal site behind on the adjacent property. 2. Mr. Powell viewed sides and bottom of NLCID from access road around perimeter while driving behind NLCID to start with illegal site on adjacent property. Sides need mowing to confirm appropriate cover, erosion rills repaired and to maintain NLCID. Sides of NLCID have become overgrown while waste is now exposed in some areas due to steep slopes and insufficient soil cover. North side NLCID 4. Property lines were not marked but one stake was present marking where the parcels come together. A couple small holes were dug near obviously buried waste. Holes dug nearby with waste sticking out of ground was observed. Holes dug near exposed waste sticking out of the ground. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 4 of 6 5. IS782201 – Buried waste is visible in some areas with logs sticking out of ground. Some waste is still buried along northern edge partially buried, including concrete and vegetative wastes. Along the north side has a higher elevation, some due to waste and some do to lay of the land it seems. All buried wastes should be removed. If it is older, composted or rotted, it is still waste and is not approved for disposal at this property. Several big limbs, logs and chunks have rolled downhill into trees, along with concrete, and should be removed and disposed properly as well. Chris Parker arrived once Mr. Miller and Mr. Powell had viewed bottom and sides of NLCID, finished walking illegal site and were making their way back to NLCID to inspect further. Mr. Powell began to explain the issues onsite to Mr. Chris Parker. Mr. Parker became agitated and frustrated with the findings and told Mr. Powell and Mr. Miller to they should leave. Mr. Powell asked,” Mr. Parker are you asking us to leave?” to confirm and Mr. Parker stated, “yes you need to leave…”. Mr. Powell and Mr. Miller immediately got in their vehicles and left the property before completing the inspections. 7. The site must continue to cease all dumping operations until corrective actions have been completed and confirmed by representatives of the Section. Additional time may be necessary and if so, communicate with Mr. Powell (910) 433-3350. Documentation of waste disposed other than the 2-acre notification should be emailed to Mr. Powell ASAP at david.powell@ncdenr.gov. 8. The Section Permitting Engineer for this county is Diana Felix, and she can be reached at (919) 707-8257 or diana.felix@ncdenr.gov. This site shall be in compliance before being permitted. 9. Corrective measures are necessary as a result of this inspection and should be completed within 30 days receipt of this inspection. A follow up will be conducted around that time or shortly afterwards to confirm. If completed beforehand, communicate with Mr. Powell and he may can schedule a follow-up as soon as possible to confirm corrective actions complete.
