OBSERVED VIOLATIONS:
A. RESOLVED:15A NCAC 13B .0405(e)(4) states: "Signs shall be posted at the site entrances unless otherwise
stated in the site permit. The signs shall be constructed of a durable, weather -resistant material. The signs shall be
clear and legible to the public. The signs shall state the name of the operator of the site, emergency contact
information, the operating hours of the site, the permit number of the current permit authorizing operations at the
site, the types of waste that can be accepted under the permit, and that hazardous waste and liquid waste cannot be
accepted at the site."
Swain County was in Violation of 15A NCAC 13B .0405(e)(4) in that signage for emergency contact
information was not posted at the entrance to the facility on July 15, 2022.

On July 20, 2022, the facility sent a photograph of the new emergency contact information sign installed at the
entrance of the facility. Therefore, the violation is resolved.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
1. All photos were taken by Lee Hill on July 15, 2022 unless otherwise noted.
2. The facility is open Monday through Friday, 7:00 am to 4:30 pm.
3. Waste is transported to the R&B Landfill in Homer, Georgia by Kinsland Trucking, Inc.
4. The site was secured by gates, fencing and natural terrain to prevent unauthorized access.
5. The access roads were of all-weather construction and were being maintained at the time of inspection.
6. Emergency contact information signage was missing at the entrance of the facility. On July 20, 2022, the
facility sent a photograph of the new emergency contact information sign installed at the entrance of the facility.
7. A response letter to the Transfer Station Assessment Report was sent on May 26, 2022, by Allen Gaither stating
that a revised operations plan needs to be submitted. Submit a revised operations plan updated in
accordance with the new requirements of 15A NCAC 13B .0404 and .0405 as well as any additional
changes necessary to ensure the document accurately reflects current operations. In addition, submit a
closure plan prepared in accordance with 15A NCAC 13B .0406 including revised closure cost estimates.

Records Review
8. Waste screening records from January 4, 2022 to July 14, 2022 were available for review. The forms showed
the final disposition of any unacceptable materials that were encountered. The facility conducts multiple waste
screenings per week to meet the requirements of 15A NCAC 13B .0405(8)(A).
9. Certified Transfer Station Operations Specialists:

10. Tonnage records from the 2021-2022 Facility Annual report showed that the facility disposed of 9,313.41tons
of waste from July 1, 2021 to June 30, 2022.
Operations Inspection of the Transfer Station (8702T-TRANSFER)
11. The transfer station consists of a covered concrete pad and a metal hopper. Waste is loaded directly into the
hopper that is located over the transfer trailer. The transfer station is only used by commercial haulers; residential
customers use the convenience site located adjacent to the transfer facility.
12. No unapproved waste was observed in the transfer trailer at the time of inspection.
13. Scrap metal was observed laying on the left side of the concrete pad at the transfer hopper. All material should
be removed from the tipping area at the end of each working day.

14. Two trailers were parked in the loaded trailer parking area; the trailers appeared to be leak resistant and meet
the requirements of 15A NCAC 13B .0105.
15. Litter was observed between the loading bay and the loaded trailer area. 15A NCAC 13B .0405(10) states in
part: "Windblown waste: Site staff shall conduct daily inspections for windblown waste on the site
property. Windblown litter from site operations discovered during the daily inspections or
observed on adjacent properties shall be picked up and containerized for disposal by the end of
each operating day..." Facility staff began working on cleaning the area during the inspection.
16. The leachate collection system is connected directly to the Bryson City Sanitary Sewer System. The loading bay
and loaded trailer areas have sump pumps installed to pump leachate to the sewer system. The leachate pumps
appeared to be functioning as designed at the time of inspection.
Operations Inspection of the Scrap Tire, White Goods and Electronics Areas
17. Scrap metal and white goods are collected on a concrete pad next to the electronics area. Facility staff remove
refrigerants onsite before the materials are sent for recycling. White goods containing refrigerants were
observed to be stored upright and separate from other scrap metal.
18. One trailer is staged to the southeast of the scale house to receive scrap tires. The contracted tire hauler was in the
process of swapping trailers at the time of inspection and no scrap tires were stored outside the trailer.
19. Electronics are collected undercover, palletized or placed in Gaylord boxes to the south of the scale house before
being sent for recycling.
