Notification was recorded with Davie County Register of Deeds on January 2, 2011. PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: 1. CORRECTIVE MEASURES IN PROGRESS: 15A NCAC 13B .0566(3) states: `All waste shall be covered with no less than six inches of soil monthly, or when the working face reaches one acre in size, whichever occurs first. Any soils usedfor cover at the site shall meet unrestricted use standards for soils as defined in G.S. 130A- 310.65 ". Since the last inspection that was conducted on July 4, 2022, a significant amount of waste was observed covered with soil. Mr. Hicks stated his staff have been working on getting the waste compacted and covered. CORRECTIVE MEASURES IN PROGRESS: 15A NCAC 13B .0566(2) states: "Solid waste in the landfill shall be compacted. Slopes shall not exceed a ratio of three horizontal to one vertical at any time ". During the inspection facility staff have push and compacted the waste to a gradual slope of less than a 3:1 grade on the north side of the landfill. The steepness of the southern side slope was pointed out to Mr. Hicks and discussed how to achieve the 3:1 slope, ensuring all waste is within the allotted 2-acre footprint. OBSERVED VIOLATIONS: None The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. The facility was recorded as allowed under 15A NCAC 13B .0563(3) for land clearing and inert debris landfills under 2 acres in size. Ensure that the landfill footprint remains under 2 acres in size. 2. Access to the site is secured by a gate. 3. 15A NCAC 13B .0566(6) states in part: "An operator shall be on duty at all times while the site is open for public use to assure compliance with operational requirements and to prevent acceptance of unauthorized waste". 4. The access road into the site was in good condition at the time of the inspection. 5. Ensure all edge of waste markers are visible around the perimeter of the disposal area ensuring the landfill does not exceed the maximum footprint of 2 acres. 6. 15A NCAC 13B .0563(6) requires all notified LCID's actively operating on the effective date of the readopted rule to either close by no late than January 1, 2026 or apply for and obtain a permit for continued operations. Because this facility is already at its maximum footprint of 2 acres, either initiate closure in accordance with 15A NCAC 13B .0567 or submit a permit application to the Solid Waste Section.
