ADDITIONAL COMMENT
1. David Powell, with the Section, inspected the Lumberton LCID on June 7, 2022, for the routine comprehensive inspection but also in response to a recent fire notification on 6/30/2022. The fire was contained in a smaller area of Yard Waste (YW) but was put out before it became out of control. A soil berm was built around the YW to contain fire and control leachate runoff from firefighting water. Leachate will be collected and taken to local wastewater treatment plant.
2. Site still is gated with proper signage. Documentation of daily loads of waste across scales for June and July 2022, were emailed by Mr. Armstrong after inspection. Mr. Armstrong also stated that they would be
upgrading the scale system to be digital and generate data digitally and get away from paper and pencil records.
3. Site had a yard waste mulching area PREVIOUSLY approved for mulching. There was a good amount of YW present on day of inspection. Be sure and not to stockpile more than the previously approved 8,000 cubic yards as well as only accept “leaf and limb” waste. Remove all unapproved waste. Manage and grade so waste is not in water and so that leachate doesn’t leave or run outside of the yard waste area. City personnel who dump should be aware of what wastes are not approved. Follow guidelines of previous permit condition until new guidelines are approved. Upon discussion with Mr. Armstrong, they will look at additional avenues for utilizing/disposing the YW mulch other than just Robeson County landfill as
ADC. Since it contains yard trash is must meet 15A NCAC 13B .1406 rules before it can go to anyone in the public, or it can go to a boiler or to a landfill for disposal of that waste type.
PREVIOUS - Facility Permit Issued September 29, 2010 Attachment 3, Part I (7) - A mulching operation at this facility is permitted in a three-acre area northwest of Phase III in accordance with the approved plan referenced in Attachment 1, Part II of this permit (List of Documents For the Approved Plan). Only leaf and limb yard waste shall be accepted. The waste shall placed in wind rows not to exceed 20 feet in height, 25 feet in width and 200 feet in length. The total volume shall not exceed 8,000 cubic yards before the waste is processed.
4. Mulch area needs to be built up and graded so leachate doesn’t run off. This has been done some but once YW is removed be sure and address entire area that is used for YW in future. Leachate, which is any water that contacts waste, must be managed onsite and not discharged. This site should meet 15A NCAC 13B .1404 rules with the design of the pad in which any operations are conducted. Waste in water is a violation and should be prevented as well. However, with fire response came water standing in and around waste. This water will be captured as much as possible and taken to a wastewater Treatment Plant due to the volume.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

5. The LCID sides had proper sloping and cover with a small working face. There was some recent erosion from recent rainfalls. Slopes that were steep have been addressed, please maintain moving forward. No trees or shrubs currently, please continue to stay on top of the mowing. Currently has high grass, could use mowing. Good job. Minor amount of unapproved, be sure and remove before covering with soil. Soil was staged onsite for cover and erosion replacement.
Permit Attachment 3, Part V, 17 - Solid waste in the landfill shall be compacted. Slopes shall not exceed a ratio of three horizontals to one vertical (3:1) at any time.
YW are visible from the LCID working face.
6. Edge of Waste (EOW) permanent markers have been added as requested to the LCID EOW, future cells and the flood plain edge by the cities Engineer. Good job. Please maintain and replace if damaged in future.

7. Be sure and follow up with Section Permitting Diana Felix on Permit modification. Her contact information is diana.felix@ncdenr.gov or (919) 707-8257. Document where any YW is taken and be sure it meets rule. Document leachate to WWTP for future reference as well. Manage remaining leachate onsite using best management practices.
