OBSERVED VIOLATIONS: None. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. The facility is permitted as a C&D transfer station and wood waste treatment and processing facility. 2. The facility operates under two separate permits. The transfer station permit (2908-TRANSFER-2013) has been issued as a life of site permit; the treatment and processing permit (2908-TP) must be renewed in 2023. Work has started on plans to enlarge the facility office and the equipment maintenance shop. These plans appear to have no impact the permitted operations or the configuration of the existing transfer station and treatment and processing facility. 4. The transfer station has been inactive since 2019, due to market fluctuations, and the staffing and space required to separate the recyclable materials from the C&D waste. Todd Warfford stated that he is considering a plan to reconfigure the transfer station so that all operations would occur in an enclosed space. He discussed extending the existing transfer structure straight out to the west on the existing concrete pad to allow C&D waste to be unloaded directly onto an enclosed tipping floor. 6. Please note that any changes to the facility or to facility operations may require a modification of the facility’s permit to operate. Records Review: 7. The permitted service area for the facility consists of a 50-mile radius and includes Cabarrus, Davie, Davidson, Forsyth, Gilford, Montgomery, Randolph, Rowan, and Stanly Countries. 8. The Permit to Operate and the approved Operations Manual are maintained at the facility’s office/scale house and are available for review upon request. 9. Tonnage records for the year from were available for review upon request. Records showed that the total tonnage for the fiscal year to May was 19,209.41. Mr. Warford stated that no C&D waste had been accepted at the transfer station for the fiscal year. 10. Training records were not verified at the time of the inspection due to the ongoing construction for the new facility office. A certified transfer station operator must be onsite if the transfer station resumes operation. Field Inspection: 11. The entire facility was observed to be clean and well-maintained. 12. All roadways are of all-weather construction and in good condition. 13. The facility appears to conform to buffer requirements. 14. The facility is accessed through two sets of locking gates while wooded areas and terrain prevent entry from other points around the property. 15. Proper signage was observed at the facility entrance. 16. Waste is placed on a concrete tipping floor located just southeast of the scale house to be separated and screened for any unaccepted waste to be removed and placed into waste receptacles. Waste receptacles are transported to the Davidson County Landfill (permit #2906-MSLF-2008) for proper disposal. 17. Mulch and boiler fuel operations are kept separated to prevent cross-contamination. 18. Brush, land clearing debris, and clean wood waste are ground for mulch. The mulch is stored in windrows to the north of the tipping floor and are turned/moved to prevent the compost process from occurring. The windrows are of manageable size with adequate access for fire control measures. 19. Processed wood waste to be sold as boiler fuel is stockpiled on the southern portion of the site along with bark that is brought to the facility as finished product and offered for sale to customers. Piles were found to be of manageable size with fire lanes designed to provide easy access. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 3 of 3 20. C&D transfer station tipping floor was being used to store a large inventory of lumber. The lumber was palletized and elevated off the tipping floor. The fabric canopy of the transfer building appeared to have minor damage with holes in the fabric. Mr. Warfford stated that the facility was looking to replace the fabric canopy soon. The picking line was idle and clean, with no accumulated waste visible. 21. The product storage area is located immediately south of the scale house and consists of a series of concrete bunkers that hold various sizes and types of stone, sand, and mulch. This area is paved and well-maintained so that it is easily accessed by customers and facility equipment operators.
