Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1. Proper signage was observed at the entrance of the facility. 2. The facility is permitted to receive solid waste generated within Lincoln County. 3. The facility accepted an average 166.79 tons per day (April 2019-June 2019), 165.42 tons per day (July 2019-June 2020), 161.76 tons per day (July 2020-June 2021) and 161.99 tons per day (July 2021-April 30, 2022). 4. The facility stopped accepting waste in the C&D unit March 2019, and all waste is now being directed to the MSWLF. Operations Inspection of the MSW Landfill Unit: 5. The facility is currently working in Phase 3. 6. One tire was observed on the edge of the working face. Facility staff stated it would be pulled out and taken to the scrap tire area for disposal. 7. Edge of waste markers were observed. 8. All access roads maintained in good condition. 9. Working face was small and compact. 10. The facility utilizes soil and spray -applied Mortar Coating (SMC) for daily cover. 11. Slight amount of windblown was observed along the northern roadway to the working face. Waste observed appeared to be no more than from daily activities. Windblown waste was being collected during the inspection. Scrap Metal Collection Area 12. Area is well maintained. 13. White goods and scrap metals are staged on a concrete pad with push -walls. 14. CFC's are removed from all white goods at the convenience centers by Carolina Metals Group. CMG is responsible for picking up their containers and transporting to their facility in Dallas. 15. All scrap metal collected at the landfill is hauled to Carolina Metals Group by facility staff. Scrap Tires 16. Scrap tires are collected and stored in US Tire semi -trailers. 17. Area is organized and well maintained. Electronics Recycling 18. All electronics are collected and taken for recycling by Synergy in Greensboro. 19. Electronics are staged and shipped from the scrap metal concrete pad. 20. Electronics were wrapped on pallets ready for Synergy to pick up on July 13, 2022. Used Oil Collection 21. Area is clean and organized in a fenced area located on the NW side of the office building. Citizens are escorted to the area for disposal. 22. Used oil is utilized for heating the shop at the facility. Small Type 1 Composting - Yard Waste 23. Lincoln County owns the tub grinder used to process the yard waste. 24. Area was well organized and maintained. 25. Unacceptable waste discovered in the yard waste pile is pulled out before loading into the tub grinder. 26. Good access around windrows and finished pile for access by firefighter equipment. A copy of the current permit and operations plan are maintained in the landfill office. 28. lst Semi-annual groundwater monitoring dated April 2019, 2nd Semi-annual groundwater monitoring dated October 2019, lst Semi-annual groundwater monitoring dated April 2020, 2nd Semi-annual groundwater monitoring dated October 2020, lst Semi-annual groundwater monitoring dated April 2021, 2nd Semi-annual groundwater monitoring dated October 2021 were reviewed. Leachate monitoring is performed semi-annually with their groundwater monitoring. 29. The landfill gas monitoring plan consists of gas monitoring wells MMW-1,2,3,4,5,6,7, and 8, along with the landfill shop, scale house. 30. Landfill gas monitoring is performed by facility staff monthly and results are submitted to the Section quarterly. The most recent monitoring event occurred on March 30, 2022. 31. Random inspection reports were reviewed. Facility staff perform one (1) random inspection each day at the MSWLF. Records reviewed were from March 1, 2022 to June 25, 2022. 32. The facility has two 325,000 gallon, above ground storage tanks. 33. Leachate is gravity fed to the lift station which pumps the Leachate up to the Leachate tanks. 34. Leachate is pumped and hauled by landfill staff to the City of Lincolnton WWTP. 35. Certified Operators are as followed: David M. Billy Bracebridge - Certified Landfill Operations Specialist expires March 22, 2022, extended till Sept.
