Brownfields Project No. 25054-21-062 Dear Mr. Hanley:
The North Carolina Department of Environmental Quality Brownfields Program (DEQ
Brownfields) received and reviewed the Vapor Intrusion Mitigation System Design Report -
Revision 2, dated June 29, 2022 (Work Plan). DEQ Brownfields comments to previous revisions of this Work Plan have been addressed; and we have determined that this Work Plan is in compliance with the DEQ Brownfields Program Vapor Intrusion Mitigation System (VIMS)
Design Submittal Requirements Checklist dated July 2021. Consistent with standard brownfields vapor intrusion provisions which will be included in the future brownfields agreement for this project, an essential component of public health protection for this design is the professional engineer’s seal of these documents that the proposed design
will be effective at mitigating the potential for vapor intrusion at the property and protecting public health. Furthermore, the safe occupancy of the building will be evaluated upon system effectiveness, sub-slab soil gas sampling, and indoor air sampling (if warranted) as required by Section 4.0: “Post-Construction/Pre-Occupancy System Effectiveness Testing” of the VIMS Design. In addition, DEQ Brownfields reserves the authority to require confirmation of efficacy
in the future. Please be advised that this approval from DEQ Brownfields does not waive any applicable requirement to obtain any necessary permits, licenses or certifications which may be required from other state or local entities.
