STATUS OF PERMIT: C&D Landfill Permit to Operate (PTO) issued October 7, 2021 Life of Site Permit for Phases 1, 2 and 3 T&P Operation PTO issued in conjunction with C&D Landfill PTO T&P Operation PTO expiration date September 27, 2024 PURPOSE OF SITE VISIT: Partial Inspection STATUS OF PAST NOTED VIOLATIONS: A. Status – Resolved: 15A NCAC 13B .0203(d) cited for failure to follow permit condition Attachment III, Part VI, General Permit Condition Number 2 which requires materials that are not recoverable, but which were received within the sorting area, will be reloaded and hauled to the landfill for proper disposal. Treated wood, painted aggregate or any other type of non-recoverable material was not observed on the reclamation pad during this inspection. Status: Resolved - 15A NCAC 13B .0203(d) cited for failure to follow permit condition Attachment III, Part VI, General Permit Condition Number 4 which requires that C&D wastes placed on the reclamation pad must be processed at each operating day, and no waste shall be remained on the pad after operating hour unless the remnants are covered by tarp, properly secured by weight, to prevent leaching by rainfall. A small stockpile of clean wood consisting of tree limbs and non-treated pallets observed on the reclamation pad. In addition, all brick and concrete observed was clean and no painted aggregate observed. No non-recoverable material appeared to have been stored on the reclamation pad overnight. C. Status: Resolved - 15A NCAC 13B .0203(d) cited for failure to follow permit condition Attachment III, Part VI, General Permit Condition Number 4(a) which requires that only an amount of C&D waste sufficient to begin sorting operations the next day may be left on the pad. A small stockpile of clean wood consisting of tree limbs and non-treated pallets observed on the reclamation pad. In addition, all brick and concrete observed was clean and no painted aggregate observed. No non-recoverable material appeared to have been stored on the reclamation pad overnight. D. Status: Resolved - 15A NCAC 13B .0203(d) cited for failure to follow permit condition Attachment III, Part VI, General Permit Condition Number 7 which requires that all non-recyclables must be properly removed from the pad, placed inside storage containers or in trucks and disposed in the C&DLF unit by the end of each operating day. A small stockpile of clean wood consisting of tree limbs and non-treated pallets observed on the reclamation pad. In addition, all brick and concrete observed was clean and no painted aggregate observed. Any non-recyclable material on the reclamation pad from the previous operating day was properly disposed of at the end of the previous operating day. ADDITIONAL COMMENTS On July 1, 2022, Chuck Kirchner met with Seth Heath to conduct a follow-up compliance inspection on the reclamation pad of the WI High Point Landfill, LLC - C&D Landfill and C&D Treatment and Processing Operation located on Riverdale Drive in Jamestown, Guilford County. 1. The facility is a construction and demolition debris (C&D) landfill with a C&D treatment and processing (T&P) operation. Only the T&P operation was observed today. 2. The C&D landfill was open and receiving material during this inspection. 3. A large amount of treated wood and painted brick and concrete that had been on the reclamation pad was removed in a very timely manner by facility staff. 4. All ground and unground treated wood, all painted brick and concrete, and any other non-recoverable wastes stockpiled at the reclamation pad have been disposed of in the C&DLF unit. 5. Mr. Heath provided waste manifests for materials removed from the reclamation pad and placed in the C&D landfill during this inspection. 2,012.10 tons of material with a disposal amount of $26,565.56 was removed from the reclamation pad and placed in the C&D landfill. 6. The mechanical picking line is currently not being used. Mr. Heath stated that the facility staff are not utilizing the sorting line in low volume situations, however, they still sort and separate recoverable materials with machinery. 7. Treated wood may not be ground. All treated wood must be delivered to the C&DLF unit at the end of each operating day. 8. Ensure permit conditions and operations plan are followed for the volume of material that can be processed and the management of materials at the reclamation pad. 9. Mr. Heath stated that all his customers had been contacted and that they are currently aware of any new operational changes. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
