The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
The facility is a transfer station owned by GFL Environmental USA Inc and is located on property that includes the Waste Industries Stone Park Court Land Clearing and Inert Debris County Landfill (Permit# 32J-LCID). Per Mr. Davidson, the
LCID landfill has been inactive for several years and is in the process of being closed out. Hilco Transport, Inc operates the transfer station which processes approximately 800 tons of MSW and 100-150 tons of C&D waste per day. Incoming trucks can/will be diverted to City of Durham Transfer Station (Permit# 3212-Transfer-2014) when the facility has reached full operational capacity. Processed MSW is transported to Sampson County Disposal, LLC (Permit# 8202-MSWLF-2000), and C&D waste is shipped to Red Rock Disposal C&D Landfill (Permit# 9228-CDLF-2001). Recyclable and recovered materials such as cardboard, metal, and concrete are removed and transported to Wake Reclamation, LLC (Permit# 9224-MWP-2012). 1. The facility accepts waste Monday through Friday from 7am to 4pm and is fenced and secured by a locking gate when it is not open for operation. Correct signage is posted at the entrance of the facility listing the facility name, permit number, emergency contact information, as well as a list of non-acceptable wastes.
2. The facility permit and operations plan were available on-site and reviewed with the General Manager and other staff. Ensure all NCDEQ representative contact information within the operations plan is up to date. 3. Waste screening reports were verified up to 6/16/22. The facility conducts screenings on approximately 5% of loads received. 4. The transfer station tipping floor has two receiving areas; C&D waste is processed on the left half of the tipping floor, and MSW is processed on the right half. A large amount of C&D waste has spilled over the small concrete barrier between the MSW and C&D areas, leaving no physical barrier separating the two processing areas. This arrangement can result in commingling of MSW and C&D wastes. Ensure C&D spillover waste is removed from the MSW processing area and kept to the left side of the concrete barrier wall. 6. The tipping floor is in generally good condition. Mr. Davidson stated that the C&D tipping floor was replaced in
2021. 7. Windblown waste was being managed properly and active cleanup was occurring during this inspection. Two large sections of missing metal siding on the left side of the C&D tipping floor could be potential pathways for waste to escape the processing area. Recommend that these areas be closed off with metal siding in a manner consistent with the rest of the building to avoid potential windblown waste. 8. Leachate drains were clean and free of debris. Leachate flows from the tipping floor to collection drains located in
the truck load-out bays, which convey it to an oil water separator tank. Separated oils and sludge are pumped by Ivey’s Septic Tank Service, Inc; remaining leachate is piped to the North Durham Water Reclamation Facility (WRF). 9. During this inspection, leachate was observed leaking from a loaded MSW transfer trailer located in the load-out bay. When the leak was pointed out to staff, it was attributed to a faulty rear clamp, and an onsite maintenance truck responded quickly to repair it. Mr. Davidson followed up with NCDEQ later in the same day (6/16/22) with pictures of the repaired trailer. Ensure all transfer trailers are inspected for deficiencies and repaired as needed.
10. The interior walls of the transfer station were clean and free of dirt and grime. Spillover waste was observed in the truck load-out bays. Mr. Davidson stated that these were cleaned out between every 2-3 loads, depending on need. 11. During this inspection, it was noted that remnants of sealed granite countertops and painted block were mixed in
with the gravel fill which makes up the main LCIDLF access road. Ensure all prohibited material is removed from this area and properly disposed of. 12. Digital photographs were taken during this inspection.
