PEGRAM & SON, INC. 3221 WILMINGTON HIGHWAY FAYETTEVILLE, NC 28306 PARTICIPANTS: David Powell, SWS Mickey Pegram, NLCID STATUS OF PERMIT: Notified 1996; PURPOSE OF SITE VISIT: Routine Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: N/A OBSERVED VIOLATIONS: N/A The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. David Powell with the Solid Waste Section (Section) visiting the site to determine the status of the Notified Land Clearing Inert Debris Landfill (NLCID). Mr. Powell attempted to visit the site, but it was behind a locked gate when he first arrived. Mr. Powell went to the facilities contact address and spoke with attendant at the office. The attendant called Mr. Mickey Pegram, and he indicated that the gate was now open, and he was present at the landfill, and for Mr. Powell come back to the NLCID. Mr. Powell returned to the NLCID and met Mr. Pegram onsite, and both walked the limits of the landfill. 2. Upon inspection, there was a small amount of older yard waste uncovered on the western limits of the NLCID. There was also some asphalt and concrete waste, with some painted brick and block comingled, in this area. Upon inquiry with Mr. Pegram, he showed Mr. Powell where the corner for the Edge of Waste (EOW) was on this corner. Some of this waste was beyond this corner and EOW. All approved waste should be inside the limits of the 2-acre notification and meet buffers. Painted brick and block needs removal to C and D landfill and weight ticket documented provided to Mr. Powell. A large piece of plastic and a metal pipe were also present in the vegetative loads, needing removal to appropriate disposal site. All painted block must go to C and D landfill, and all LCID approved waste should be inside limits of notification, covered and sloped 3:1. It has been inactive for a long time with the exception of these few loads in recent months. Mr. Powell asked if Mr. Pegram uses it often and he does not. Center of NLCID covered and grassed. Mr. Powell emailed Mr. Pegram on 6/20/2022 the newest LCID rules and the Letter sent by the Solid Waste Section Chief, Edward Mussler, for Owners or Operators of Notified Land Clearing and Inert Debris Landfills to explain the Readopted Rules and Regulatory Requirements for Notified LCID Landfills, including closure of all NLCIDs by January 1, 2026. Mr. Pegram stated he had received the letter earlier but didn’t understand it. Mr. Powell explained the rules and the requirements of the letter. 5. Mr. Powell later emailed that Mr. Pegram had until January 1, 2026, to use the NLCID if he chose too, but if he did so then the NLCID would be considered active. In that case, the site must meet the new rules and should meet all rules and operational requirements. Mr. Pegram would also have to close according to rule by January 1, 2026 and be required to go by the Post Closure care rules as well. If Mr. Pegram wanted to consider this NLCID closed, and not use it anymore, then he must remove the unapproved waste and dispose of it at the appropriate disposal site. The remaining waste must be inside the two-acre notification, meet buffers, be compacted, covered with at least 12 inches of soil, and sloped 3:1. Be careful not to put waste in water. A follow up will be needed to ensure buffers are met and waste is inside the EOW for the two-acre approved disposal area. Please mark the four corners of the Edge of Waste (EOW) to measure size of the waste disposal and to measure buffers. A time frame of 60 days was discussed onsite; however, Mr. Powell will attempt to return around the 30-day mark and evaluate the progress of the corrective actions. 6. Corrective measures are necessary as a result of this inspection and should be completed within 60 days’ receipt of this report.
