The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. David Powell with the Section onsite to follow up. Concrete crushing and separating is needed soon. Discussions onsite also included the future plans to open a permitted LCID. Permitting Engineer onsite for Cumberland County is now Jordan Russ, (919) 707-8229/jordan.russ@ncdenr.gov, and should the point of
contact for the Section in permitting a new LCID. A Surveyors map was also provided, photo taken, to show new corners marking the 2 acre notification had been marked, as well as buffers, as requested recently.
N1091 1. Front NLCID had a small working face, and no unapproved wastes were visible while onsite.
2. There was good cover and a small working face. This NLCID is reaching its end based on onsite observations and discussion with Mr. Hunt. Be sure and cover, slope correctly moving forward and prepare to close according to new rules. This NLCID will also need to be maintained for post closure care as required by rule also, rule reference 15A NCAC 13B .0567. Some mowing is still needed around the sides. Discussions were that soil could be added to bottom of slope to assist with updating the slope to 3:1, since this area was built before the requirement. Also, the soil will be beyond the EOW, but no waste is beyond or should be disposed, beyond the limits of the NLCID. Soil was added and slope corrected 3:1 in almost all areas. Still some minor work needed on eastern side to slope 3:1, please address.

1. Road access was in good shape. Working face was within an acre and waste was being compacted and covered. A couple pieces of unapproved wastes were present, in which Mr. Hunt had it removed before
being covered.
2. Waste that was outside EOW has been removed and put back inside the limits of the notification, covered and sloped. All EOW markers were present and visible. Exposed waste along roadway has been covered. Be sure and cover/slope exposed waste along SE corner of the notification.
South side, covered and sloped 3:1.

West side, access road is all weather. EOW markers present.
South East corner had some exposed waste still needing cover.

North side covered and sloped. Waste outside EOW has been removed and back inside EOW. Markers present.
