OBSERVED VIOLATIONS: A. CORRECTIVE MEASURES IN PROGRESS: 15A NCAC 13B .1626(7) states that “Erosion and sedimentation control requirements. Erosion control measures consisting of vegetative cover, materials, structures, or other devices shall be utilized to prevent silt from leaving the site and to prevent on-site erosion, and shall comply with 15A NCAC 04, which is incorporated by reference including subsequent amendments and editions.” During the inspection, the northern side of the landfill was observed from the eastern perimeter roadway. The slope had several erosion rills that were ankle deep running down the landfill. Mr. Rickett stated that this area had been damaged by heavy rain events that occurred prior to the inspection and that they were waiting until the soils dried before starting the repair on the side slope. The City of Winston-Salem and City/County FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 Utilities Commission are in violation of 15A NCAC 13B .1626(7) for failing to prevent on-site erosion. To achieve compliance, ensure that erosion control measures are in place to prevent on-site erosion. Corrective Measures in Progress: 15A NCAC 13B .1626(7), on June 10, 2022 the northern side of the landfill was observed to have been regraded to repair the damaged slope. The facility appeared to be well maintained with the entire facility observed to be clean; however, some windblown litter was observed along the facility’s main road. A facility litter pick-up crew was observed collecting litter during inspection. Ensure that windblown litter is collected and returned to the working face at the end of every workday. 2. Access roadways are of all-weather construction and maintained in good condition. The main roads at the site are paved and kept free of debris. The unpaved portion of the site’s roadway system is constructed of compacted clay, with crushed concrete/asphalt/brick (CAB) debris applied as necessary to maintain a hard, stable surface suitable for big trucks and heavy equipment. 3. The CAB collection area is located just off the access roadway at the north corner of the closed landfill unit. The area is gated and kept locked. Customers identified at the scale house with clean loads of CAB debris are met at the CAB area by facility staff, who screen the load for unacceptable materials before allowing it to be dumped. At the time of this inspection the area was relatively clean. Mr. Rickett stated that they had just recently crushed most of the stockpiled CAB material. No unacceptable materials were observed at the site. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. The white goods/scrap metal collections area is located west of the CAB area on a concrete pad originally designed as a transfer station tipping floor. At the time of inspection, the white goods units containing refrigerant gases were staged in an upright position and lined up for easy access by the CFC removal contractor. Mr. Rickett stated that the contractor should be on site in the next few weeks to drain the white goods containing the refrigerant. The area is manned during the facility’s hours of operation to assist the public and to screen loads. The area appeared to be clean and well organized. 5. The leachate tanks were observed from the access roadway and appeared to be in good condition. No leaks were evident. Mr. Rickett stated that the leachate lines were last cleaned in 2018. 6. The scrap tire area was clean with four tire trailers parked. Two of the trailers appeared full at the time of inspection. Mr. Rickett stated that the scrap tire collection was contracted out. 7. The residential convenience area was clean and well maintained. 8. The northern side slope was damaged by rain events with the remaining exterior side slopes observed to be in good condition. 9. The working face was well defined, and the equipment operators were working to spread, grade, and compact the waste. No unacceptable material was observed in the working face. 10. The working face was small enough to be maintained by the facility staff. The operations area around the working face provided sufficient space for trucks and equipment to operate. A spotter was observed directing incoming and outgoing traffic. 11. The tarps used for alternate daily cover was observed on site at the working face.
