Slopes shall not exceed a ratio of three horizontal to one vertical at any time”. The working face of the landfill was observed to be near vertical in slope. To achieve compliance the working face needs to be reworked to achieve a 3:1 slope. LCID material appeared uncompacted on the working face of the landfill. LCID material cannot be compacted until landfill slopes are reduced to a grade that is accessible to heavy equipment required to compact waste. ADDITIONAL COMMENTS 1. Mr. Thomas was unable to be present at the time of the inspection. 2. The facility is a notified land clearing and inert debris (LCID) landfill, permitted to receive yard waste and inert debris for disposal per 15A NCAC 13B .0563(1). 3. Ensure any incidental unacceptable waste received is removed for proper disposal before waste is placed in the landfill. 4. The site was found to be clean and well maintained. No windblown litter was observed. 5. The facility is protected from unauthorized access by means of berms, natural topography, fencing and a locking gate which is secured when the facility is not open to the public. Proper signage was observed at the facility entrance. 6. The site has an adequate soil stockpile on site to provide cover material for the facility. 7. The working face was under an acre in size and was uncovered at the time of inspection. Please ensure that the working face of the landfill is covered at least monthly with at least 6” of clean soil. Adequate soil cover must be applied to the landfill by June 31, 2022 – one month from the date of this inspection. 8. The access roadway was of all-weather construction and in good condition. The large tipping area was level and provided ample room for trucks and equipment to maneuver safely at the facility. 9. 15A NCAC 13B .0566(8) states, in part, “An attendant shall be on duty at all times while the landfill is open for public use to assure compliance with operational requirements and to prevent acceptance of unauthorized wastes.” Please ensure that an operator is on duty at all times when the landfill is open to the public. 10. Rule 15A NCAC 13B .0563 states that “the owner or operator of a land clearing and inert debris (LCID) landfill shall obtain a permit from the Division.” This rule requires all notified LCIDs to become permitted within 5 years of the readopted date, January 1, 2021, or close in accordance with Rule .0567(b). A copy of this rule can be found at: 15A NCAC .0563 The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
