The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. David Powell with the Section, Solid Waste Section, inspected the Wallburg Sand Yard Waste Notification,
YWN, for a routine comprehensive inspection. Mr. Powell spoke with Robbin Jones on scheduling a site visit beforehand. Mr. Powell spoke with Ms. Robbin again on 6/2/2022 about if she needed or planned on using the YWN. She indicated she hasn’t and didn’t wish to bring waste from any other source than from Moore Counties Compost, via brooks Trucking, to her site. She hasn’t used any other source but when started she attempted to utilize a few loads from a source out of Richmond County which didn’t meet her needs. The YWN-77-002 will be closed and cannot accept any waste in the future. A new notification would need to be submitted and the site would need to meet current rules at that time. 2. Upon visiting the site, Mr. Powell found onsite operator JC Callicutt and introduced himself and provided a business card. Mr. JC didn’t seem to know anything about a YWN or where it was located. Upon inspection there was much mulched/composted waste onsite and West side of entrance roadway. Mr. JC explained it is
brought in by Brooks trucking, brought from Moore County he thought, and is stockpiled until it can be screened/mixed with sand to make a soil amendment/topsoil product. Some was visibly used on side slopes of the mine for erosion control. No Edge of Waste (EOW) markers were found to outline where the 2-acre
notification was to measure amounts inside of the notification, buffers etc. After the inspection and speaking with Ms. Robbin and Moore County representatives Phillip Boles and Bill Zell, it was determined that Brooks Trucking was used to haul a composted YW from Moore County, which has met time and temperature records,
to Wallburg Sand. The Sections rules have been met with this product at this point, according to the information provided by Moore County Staff. 3. The Yard Waste Notification will be considered closed and can no longer accept waste in the future. The compost onsite at Walhburg Sand has been determined to be a composted product and not regulated at this point.
